cv <br />STATE OF NEBRASKA ) <br />)ss: <br />COUNTY OF HALL ) <br />SUBSCRIBED AND SWORN to before me this <br />AFFIDAVIT OF LIEN <br />l) <br />tft <br />zr <br />Index this Affidavit of Lien against the following described property: <br />Lot Eight (8), in Amended Block Six (6), Continental Gardens, an <br />addition to the City of Grand Island, Hall County, Nebraska. <br />AND FURTHER AFFIANT SAITH.NOT. <br />COMES NOW Galen E. Stehlik, and after being first duly sworn upon oath, would hereby <br />depose and state as follows: <br />1. I am an attorney licensed to practice law in the State of Nebraska. I am the agent <br />for, and I represent, the Continental Homeowners Association. <br />Cr) <br />m <br />r <br />r x <br />2. Pursuant to an Amended Declaration, found at Document #95- 108944 in the <br />office of the Register of Deeds of Hall County, Nebraska, the Continental Gardens Homeowners <br />Association ( "the Association ") has the right to make assessments against property located in Continental <br />Gardens. <br />3. Pursuant to Article VIII, paragraph 9 captioned "Notice of Lien ", the Association <br />is entitled to a lien on any property for failure to pay assessments: <br />"9. Notice of Lien. At any time any assessment becomes more than thirty <br />(30) days past due, the Association or its agents may file of record an affidavit <br />stating the facts relative thereto, which affidavit shall serve as public notice of the <br />existence of the lien, and that the lien shall also cover unpaid assessments which accrue <br />after the date of the filing of the lien. No purchaser or mortgage holder who does not <br />have personal or public notice of the lien shall be subject thereto and the lien shall not be <br />foreclosed where any such bona fide purchaser or mortgages has an interest of record in <br />said lot." <br />4. This document shall serve as the Affidavit of the agent of the Association stating <br />that as of the date hereof, the following described property is subject to past due assessments in the <br />amount of $261.00. This lien not only covers the past due assessments in said amounts, but also covers <br />unpaid assessments which accrue after the date of the filing of this lien. <br />t eet/;1 4 7 6 4 , 17A <br />n E.
