<br />according to the terms of the Note, with any and all extensions, renewals, modifications, or
<br />substitutions thereof and each and every other debt, liability and obligation of every type and
<br />description, including guarantees or accommodations, which the Trustor may now, or at any
<br />time hereafter, owe or be obligated to the Beneficiary whether such other debt, liability, or
<br />obligation now exists, is direct or indirect, due or to become due, absolute or contingent, primary
<br />or secondary, liquidated or unliquidated, or joint, several, or joint and several. The Note and all
<br />such debts, liabilities, and obligations are all collectively hereinafter referred to as the
<br />"Obligations ".
<br />TO PROTECT THE SECURITY OF THIS DEED OF TRUST, TRUSTOR HEREBY
<br />COVENANTS AND AGREES AS FOLLOWS:
<br />1. Payment of Obligations. Trustor shall promptly pay the Obligations when due.
<br />2. Warranty of Title. Trustor is lawfully seized and possessed of good and
<br />indefeasible title and estate to the Property hereby conveyed and has the right to grant and
<br />convey the Property; the Property is free and clear of all liens and encumbrances except
<br />easements, restrictions and covenants of record; and Trustor will warrant and defend the title to
<br />the Property against all claims and demands.
<br />3. Maintenance and Compliance with Laws. Trustor shall keep the Property in good
<br />repair and condition and shall not commit waste or permit impairment or deterioration of the
<br />Property. No improvement now or hereafter erected upon the Property shall be altered,
<br />removed or demolished without the prior written consent of Beneficiary. Trustor shall comply
<br />with all laws, ordinances, regulations, covenants, conditions and restrictions affecting the
<br />Property and not commit, suffer or permit any act to be done in or upon the Property in violation
<br />of any law, ordinance, regulation, covenant, condition or restriction. Trustor shall complete or
<br />restore promptly and in good workmanlike manner any building improvement or personal
<br />property constituting part of the Property which may be damaged or destroyed and pay, when
<br />due, all claims for labor performed and materials furnished therefor and for any alterations
<br />thereof.
<br />4. Insurance. Trustor, at its expense, will maintain with insurers approved by
<br />Beneficiary, insurance with respect to any improvements and personal property constituting the
<br />Property against loss by fire, lightning, tornado, and other perils covered by a standard
<br />extended coverage endorsement, in an amount equal to at least one hundred percent of the full
<br />replacement value thereof; general liability insurance and insurance against such other hazards
<br />and in such amount as is customarily carried by owners and operators of similar properties and
<br />as Beneficiary may require for its protection. Trustor will comply with such other requirements
<br />as Beneficiary may from time to time request for the protection by insurance of the interest of
<br />the respective parties. All insurance policies maintained pursuant to this Deed of Trust shall
<br />name Beneficiary as an additional insured, loss payee or mortgagee, as applicable, and provide
<br />that there shall be no cancellation or modification without written notice to the Beneficiary fifteen
<br />(15) days prior to its expiration date. In the event of cancellation of, such insurance, Trustee or
<br />Beneficiary may procure such insurance and the cost thereof shall be added to the loan secured
<br />by this Deed of Trust and shall bear interest from the date of disbursement at the rate payable
<br />from time to time on outstanding principal on the Note unless payment of interest at such rate
<br />would be contrary to applicable law, in which event such amounts shall bear interest at the
<br />highest interest rate authorized by applicable law. Trustor shall deliver to Beneficiary upon
<br />request, copies of the original policies of insurance and renewals thereof. Failure to furnish
<br />such insurance by Trustor, or renewals as required hereunder shall, at the option of Beneficiary,
