PLEASE RETURN TO: <br />CATRINA DELOSH <br />PUBLIC WORKS DEPT <br />PO BOX 1968 <br />GRAND ISLAND, NE 68802 <br />1 <br />This Space Reserved for Register of Deeds <br />LICENSE AGREEMENT <br />This License Agreement is made by and between the CITY OF GRAND <br />ISLAND, NEBRASKA, a municipal Corporation, herein referred to as the "Licensor" <br />and LBE FAMILY LIMITED PARTNERSHIP, OWNER, hereinafter referred to as the <br />"Licensee ". <br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement <br />is to set forth the terms and conditions under which the Licensee may construct, <br />maintain, repair, and utilize the following described improvement which will infringe <br />upon the public right -of -way; <br />Installation of lawn sprinkler system to irrigate the public right -of -way abutting <br />the property at 2309 W Capital Avenue. This will include sprinkler lines, sprinkler <br />heads, control box and associated hardware. This agreement is in connection with <br />the Capital Avenue — Webb Road to Broadwell Avenue Widening in Grand Island, <br />Project No. URB- 5436(5); Control No. 42707. <br />2. DESCRIPTION OF REAL ESTATE AFFECTED. This License <br />Agreement applies to West Sixty Six (66) Feet of the North Thirty Eight and Four <br />Tenths (38.4) Feet of Lot Three (3), and the West Half (W' /2) of Lot One (1), Block <br />Six (6), College Addition to West Lawn, City of Grand Island, Hall County, Nebraska. <br />3. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that <br />the Licensee may construct, maintain, repair and utilize the above described <br />improvement at the Licensee's sole risk. The Licensee hereby waives any claim for <br />damages against the Licensor, its officers, employee, agents and independent <br />contractors for any damage or injury that may result to said improvement.
