20130/263 <br />to borrow or receive cash value in return for the surrender of any or all rights under any of the <br />following: <br />(a) Life Insurance and annuity policies, plans or benefits. <br />(b) Mutual funds and other dividend investment plans. <br />(c) Retirement, profit sharing and employee welfare plans and benefits. <br />23. To Do All Other Things, Etc. In general, to do all other acts, deeds, matters and things <br />whatsoever in or about my estate, property and affairs, or to concur with persons jointly interested with <br />myself therein in doing all acts, deeds, matters and things herein, either particularly or generally <br />described, as fully and effectually to all intents and purposes as I could do myself if personally present. <br />24. Nomination to Serve as Guardian and/or Conservator. Should it become necessary for <br />the appointment of a custodian and/or conservator for me and/or my property, I hereby nominate my <br />attorney as such custodian and /or conservator. <br />25. Ratification and Declaration in Favor of Persons Without Notice of Revocation. I <br />hereby promise at all time to ratify and confirm all that my attorney shall lawfully do or cause to be <br />done hereunder, including anything which shall be done between the revocation of this document by <br />my death or in any other manner and notice of such revocation reaching my attorney. I hereby declare <br />that, as against me and all persons claiming under me, everything which my attorney shall do or cause <br />to be done in pursuance hereof after such revocation as aforesaid shall be valid and effectual in favor <br />of any person claiming the benefit thereof who, before the doing thereof, shall not have had notice of <br />such revocation. <br />26. Power of Attorney Effective Notwithstanding Disability of Principal; Continues in <br />Effect After Principal's Death Until Notice. Pursuant to the provisions of Nebraska Probate Code <br />Section 30 -2665, I declare that this power of attorney shall not be affected by my subsequent disability <br />or in capacity and that the authority granted herein shall continue during any period while I am <br />disabled or incapacitated. Further, pursuant to Section 30 -2668, all such authority shall continue after <br />my death until notice of my death shall have been received by my attorney so that my attorney has <br />actual knowledge of the fact that I have died. Any action taken in good faith by said attorney during <br />any period while it is uncertain whether I am alive, before my attorney receives actual knowledge of <br />my death or, in any event, taken during any period while I am disabled or incapacitated, shall be as <br />valid as if I were alive, competent and not disabled. <br />27. Revocation of Prior Powers. I revoke all prior Durable or General Powers of Attorney <br />that I may have executed and I retain the right to revoke this Power. <br />28. Revocation of this Power. This Power can be revoked only in the following manner: <br />(a) By the execution by me of a subsequent Durable Power of Attorney, <br />unless the subsequent Power contains a statement to the contrary and specifically refers to this <br />Power by its date; or <br />
