Box 790 <br />Grand Island, NE 68802 -0790 <br />WITNESSETH: <br />DEED OF TRUST MODIFICATION AGREEMENT <br />2 01306819 <br />THIS DEED OF TRUST MODIFICATION AGREEMENT is made and executed this <br />day of August, 2013, by and between MEHRING CONSTRUCTION COMPANY, L.L.C., <br />a Nebraska limited liability company, hereinafter referred to as "Borrower ", and NIEDFELT <br />PROPERTY MANAGEMENT, L.L.C., a Nebraska limited liability company hereinafter <br />referred to as "Lender ". <br />WHEREAS, Borrower previously executed a certain secured Promissory Note dated June <br />8, 2011 in the original principal amount of Thirty -Five Thousand and No /100 Dollars <br />($35,000.00) (hereinafter referred to as the "Promissory Note "); <br />WHEREAS, the Promissory Note is secured by a certain Deed of Trust dated June 8, <br />2011, and recorded June 8, 2011 as Instrument No. 201104317 in the records of the Office of the <br />Register of Deeds, Hall County, Nebraska (hereinafter referred to as the "Deed of Trust ") in <br />connection with the following described real estate: <br />Lot Six (6), Block Two (2), Sterling Estates Subdivision in the City of Grand Island, Hall <br />County, Nebraska. <br />WHEREAS, Borrower has executed a promissory note dated August 15, 2013 in the <br />original principal amount of Thirty-Five Thousand and No /100 Dollars (the "New Promissory <br />Note "); <br />WHEREAS, the New Promissory Note replaces and supercedes the Promissory Note; <br />WHEREAS, Borrower and Lender hereby desire to amend the Deed of Trust to reflect <br />that the New Promissory Note is secured by the Deed of Trust. <br />NOW, THEREFORE, it is agreed: <br />1. Incorporation of Recitals. The foregoing recitals are specifically incorporated in <br />and made a part of this Second Deed of Trust Modification Agreement by this reference. <br />2. Modification of Security. The Deed of Trust secures the payment of indebtedness <br />evidenced by the New Promissory Note, together with interest at the rate provided therein, or the <br />principal and interest on any future advance not to exceed the total principal sum initially <br />secured hereby as evidenced by promissory notes stating they are secured hereby, and any and all <br />renewals, modifications and extensions of such notes, both principal and interest on the notes <br />being payable in accordance with the terms set forth therein, which by this reference is hereby <br />made a part hereof. <br />3. Continuing Effect. Except as specifically modified by this Deed of Trust <br />Modification Agreement, all other terms and provisions of the Deed of Trust shall remain in full <br />force and effect. <br />4. Effect on Other Security. All real estate mortgages, deed of trust, assignments <br />and security agreements heretofore or concurrently herewith to be granted shall remain in full <br />force and effect to the extent not inconsistent with this Deed of Trust Modification Agreement <br />and shall continue as security for Borrower's remaining indebtedness previously existing and <br />additional indebtedness hereinabove set forth until such sum shall be paid, as well as any future <br />indebtedness owing from Borrower to the Lender for future advances and renewals in respect to <br />all sums owing from Borrower to Lender. <br />5. Additional Documentation. Borrower further covenants to and with Lender that <br />Borrower shall, and will, at any time, now or later, upon request, make, do, execute and deliver <br />
