201306529 <br />AGREEMENT FOR SALE AND PURCHASE OF REAL ESTATE <br />KNOW ALL MEN BY THESE PRESENTS: <br />The undersigned Sellers do hereby sell to the undersigned Buyers, the following- described <br />real estate for the price and upon the terms and conditions herein set forth, and the <br />undersigned Buyers hereby accept said terms and conditions, agree to pay the purchase price, <br />and to perform the obligations of buyers hereunder. <br />1. The Sellers are: Jean M. Oltman; Ray A. Oltman and Rebecca Oltman, husband <br />and wife; Cynthia S. Barnett and Mark Barnett, wife and husband; and Cheryl K. <br />Larson and Lowell Larson, wife and husband. <br />2. The Buyer is: Victoria L. Stutzman. <br />3. The legal description of the real estate is: THE NORTH FIFTEEN (15) FEET OF <br />THE SOUTH SEVENTY (70) FEET OF LOT TWO (2), BLOCK ONE (1), 8TH <br />ADDITION TO CAIRO, HALL COUNTY, NEBRASKA. <br />4. The purchase price is ONE THOUSAND FIVE HUNDRED AND NO /100 <br />($1,500.00) DOLLARS. <br />5. The purchase shall be paid as follows: <br />A. Down payment of $0.00 upon execution of this Agreement; <br />B. $1,500.00 payable on closing with certified check or cash. <br />6. Buyers shall take possession of the property upon closing. The closing shall take place <br />August 15, 2013, however, this tentative closing date and time may be altered by <br />mutual agreement of the parties. <br />7. Upon the Closing, Sellers shall convey the real estate to Buyer by Warranty Deed, free <br />and clear of all liens and encumbrances except easements, public road right-of-way, <br />restrictions of record. <br />8. Buyers acknowledge that they have inspected the real estate and accept sale "as is" and <br />do not rely upon any representations made by or on behalf of the Sellers. Sellers <br />disclaim all warranties with respect to the sale of the real estate to Buyers. <br />9. Sellers and Buyers each agree that time is an essential element of this Agreement. <br />10. If either Sellers or Buyers breach this Agreement, then that non - breaching party shall <br />be entitled to all remedies available at law and in equity for the performance of this <br />Agreement or for damages. <br />11.
