RESIDENTIAL LEASE <br />THIS LEASE is made this 31st day of July, 2013, by and <br />between JAMIE M. CUMMINGS and ANNE M. CUMMINGS (hereinafter <br />collectively referred to as "Landlord ") and PATTY CUMMINGS <br />(hereinafter referred to as "Tenant "). <br />201306446 <br />1. Lease & Premises. Landlord hereby leases to Tenant the <br />following- described property: the house and any detached <br />structures and yard, if any, located on the following- described <br />real estate (the "leased premises "): <br />Lot Seven (7), Western Heights Third Subdivision, less a <br />tract of land comprised of the east Forty (40) feet of Lot <br />7, Western Heights Third Subdivision, City of Grand Island, <br />Hall County, Nebraska, more commonly known as 1629 Lariat <br />Lane, Grand Island, Nebraska. <br />2. Duration. This Lease shall commence on the 2n day of <br />April, 2013, and shall continue until the first occurrence of <br />any of the following events: (1) the death of Tenant; (2) Tenant <br />vacating the leased premises; (3) Tenant abandoning the leased <br />premises for more than thirty days without providing advance <br />written notice to Landlord; (4) any marriage of the Tenant; (5) <br />Tenant's cohabitation in the leased premises with a man; or (6) <br />as provided in Paragraph 4 of this Lease. Tenant hereby agrees <br />to vacate the leased premises and to deliver possession of the <br />leased premises to Landlord upon the termination of the Lease. <br />In the event this Lease terminates as the result of the death of <br />Tenant, Tenant's heirs and /or devisees shall have a period of <br />thirty (30) days from the date of Tenant's death to remove <br />Tenant's personal property from the leased premises; however, <br />arrangements for access to the leased premises must be made <br />through either Jamie Cummings or Anne Cummings, which access <br />shall not be unreasonably denied. <br />3. Rent. As Rent for the time period of April 2, 2013, <br />through December 31, 2013, Tenant shall pay Landlord the sum of <br />$1,146.81 on December 31, 2013. As Rent for all subsequent years <br />of this Lease, Tenant shall pay Landlord, annually, an amount <br />equal to all property taxes attributable to the leased premises <br />for any portion of the calendar year that this Lease remains in <br />effect. Unless this Lease terminates prior to the end of any <br />calendar year, said rent for all years subsequent to 2013 shall <br />be paid on or before December 31s of each year that this Lease <br />is in effect. Should this Lease terminate prior to the end of <br />any calendar year other than 2013, said rental payment shall be <br />prorated to and paid to Landlord on the date the Lease <br />terminates, utilizing as the basis of such proration the prior <br />year's tax levy, unless the current year's tax levy has been <br />
