General Partnership, Trustee of the Ruby L. Johnson Administrative <br />Trust dated September 27, 1994, hereinafter referred to as Affiant, and states as follows: <br />1. Affiant is Successor Trustee under a certain Administrative Trust Agreement dated <br />September 27, 1994 under which Ruby L. Johnson was the Grantor and P.L.M. General Partnership <br />is currently acting as sole Successor Trustee; <br />2. Under the terms of said Trust, Affiant, as Trustee, is specifically authorized to <br />purchase or sell real estate, to pledge real estate and personal property as security for loans, and to <br />execute all documents which are necessary in order to implement said purchase, sale or loan. <br />3. The aforementioned Trust was revocable, and that the Affiant, as Trustee, is the sole <br />party thereunder with power to exercise the powers identified herein and that said trust is now <br />irrevocable by virtue of Grantor's death; <br />4, The Trust established as set forth herein has not been amended to make any <br />representations contained in this Certification of Trust incorrect, and that the signature or signatures <br />hereafter are those of all the acting Trustees. <br />5. The Amended and Restated Partnership Agreement of P.L.M. General Partnership <br />dated September 5, 2012 and Nominee Agreement dated March 25, 2002, copies of which have been <br />provided to the title companies specified herein, are in full force and effect, and have not been <br />amended or revoked, and that the partners remain the same. <br />6. This Certification of Trust is executed and delivered in order to induce <br />Commonwealth Land title Insurance Company and. Ganz Title & Escrow Company to issue its policy <br />of title insurance on certain real estate described as: <br />A. The West Half of the Northeast Quarter (W1 /2NE1 /4) of Section 26, Township 12 North, <br />Range 12 West of the 6 P.M., Hall County, Nebraska, EXCEPTING THEREFROM a tract <br />of land deeded to Mount Pleasant Cemetery Association as shown in Warranty Deed <br />recorded in Book 122, Page 55; <br />AND FURTHER EXCEPTING the following tract deeded to Mount Pleasant Cemetery <br />Association and described as follows: <br />A tract of land being part of the West Half of the Northeast Quarter (W1 /2 NE1 /4) of <br />Section 26, Township 12 North, Range 12 West of the 6 P.M., Hall County, Nebraska, <br />more particularly described as follows: <br />Referring to the Northeast Corner of the West Half of the Northeast Quarter of Section 26 <br />and assuming the North line of the West Half of the Northeast Quarter of Section 26 as <br />00 <br />
