WILES, husband and wife, Trustors, and THOMAS LOCHER, Trustee, <br />MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. , as nominee for U.S. Bank <br />N.A., Beneficiary. Said Deed of Trust was recorded on June 26, 2009, as Instrument No. 2009- <br />05222 of the Mortgage Records of Hall County, Nebraska. Said Deed of Trust having been assigned <br />by virtue of an Assignment dated February 8, 2013 to U.S. BANK NATIONAL ASSOCIATION, <br />and which was filed for record on April 1, 2013, as Instrument No. 2013 -02572 of the Mortgage <br />Records of Hall County, Nebraska. THOMAS LOCHER, Grantor, in consideration of the sum of <br />Seventy -Two Thousand Six Hundred Fifty -Seven and 50 /100 Dollars ($72,657.50) and other good <br />and valuable consideration received from U.S. BANK NATIONAL ASSOCIATION, does hereby <br />grant, bargain, sell, convey and confirm unto U.S. BANK NATIONAL ASSOCIATION, <br />(hereinafter "Grantee" where appropriate), the following- described real property in Hall County, <br />Nebraska, to wit: <br />The Westerly 38 feet of the Southerly 140 feet of Lot 12 of the County Subdivision of part of the <br />S1 /2SE1/4 of Section 16, Township 11 North, Range 9 West of the 6 P.M., and that part of Lot <br />13 of the County Subdivision of part of S 1 /2SE 1 /4 of said Section 16, Township 11 North, Range <br />9 West of the 6 P.M., Hall County, Nebraska, and more particularly described as follows: <br />Beginning at a point 40 feet South of the Northwesterly comer of said Lot 12 and thence Westerly <br />parallel to the Northerly line of said County Subdivision a distance of 32 feet; thence Southerly <br />parallel to the Westerly line of said Lot 12 a distance of 140 feet; thence Easterly a distance of 32 <br />feet to the Southwesterly corner of said Lot 12; thence Northwesterly on the Westerly line of said <br />Lot 12 a distance of 140 feet to the point of beginning. <br />to have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. <br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />1. That PAUL R. WILES and LEAH F. WILES, as Trustors, failed to pay to Beneficiary <br />payments which were contractually due, and the Grantor, at the request of the Beneficiary, <br />elected to declare the entire unpaid principal balance, together with interest thereon at once <br />immediately due and payable. <br />2. That a Notice of Default as required by § 76 -1006 was filed by Grantor on April 1, 2013, as <br />Instrument No. 2013 -02573 in the Office of the Register of Deeds of Hall County, Nebraska. <br />A copy of said Notice of Default was thereafter mailed to all parties entitled to notice, <br />pursuant to said Deed of Trust and in compliance with § 76 -1008, R.R.S. Nebraska. <br />3. That the Trustors failed to cure the default referenced in the Notice of Default within 30 days <br />after filing of the Notice of Default. <br />4. That a Notice of Trustee's Sale was filed by Grantor on May 16, 2013, as Instrument No. <br />2013 -03903 in the Office of the Register of Deeds of Hall County, Nebraska.
