. <br />that such payment shall be endorsed upon the contract by such <br />Escrow Agent. The Vendor agrees that the Escrow Agent may deduct <br />from each payment made to it the amount of its fees and expenses <br />in connection with this matter and that it may deduct from the <br />final payment made hereunder in addition to arch expense, the <br />costs of extending the abstract of title and furnishing Federal <br />Documentary Stamps for such deed. <br />It is expressly understood and agreed that payments hereon <br />shall be first credited on interest and second upon principal. <br />It is further understood and agreed by and between the <br />parties hereto that if the Purchasers fail, refuse or neglect <br />to pay any of the payments or interest herein provided for a <br />period of 45 days, time being of the essence of this contract, <br />or fail or neglect to pay any taxes or assessment before the <br />same become delinquent or fail to keep the buildings or improve- <br />ments on such property insured as above provided, or fail or <br />neglect to keep or perform any of the terms or conditions of <br />this contract and agreement on their part to be performed, that <br />then, and in that event, the Vendor at her option may at once <br />without notice declare the whole amount of the purchase price <br />then remaining unpaid, due and payable, and such delinquency in <br />payment, or the failure in other respects by the Purchasers to <br />perform the stipulations of this contract or any part of them, <br />®hall entitle the Vendor, her heirs or assigns, to exercise all <br />and every remedy or remedies then available to her either at <br />law or in equity. <br />It is further agreed that the pigh -ts and remedies of the <br />Vendor under this contract shall be cumulative and no right or <br />remedy hereunder shall be exclusive of any other right or remedy <br />as provided for in this contract or as otherwise provided by law. <br />
