C O N D E M N A T I O N <br />Land Owners: Fred L. Kirschbaum and Marjorie B. Kirschbaum, <br />husband and wife, Joint Tenants, <br />P <br />Project: F -215 (6) AFE: R -161b Hall County, Nebraska <br />Fee simple title to a tract of land and all improvements <br />thereon, if any, for highway right of way purposes located in <br />the Northeast Quarter of Section 130 Township it North, Range <br />10 West of the 6th P.M., Hall County, Nebraska, as illustrated <br />on the attached plat and being more particularly described as <br />follows: <br />Beginning at the north quarter quarter corner of the <br />Northeast Quarter of said Section 13J thence easterly on the <br />North line of the Northeast Quarter of said Section 13 a dis- <br />tance of 75.0 feet; thence southerly on a line 75.0 feet east- <br />erly from and parallel to the West line of the East Half of <br />the Northeast Quarter of`said Section 13 a distance of 2,637.5 <br />feet to a point on the South lint of said Northeast Quarter; <br />thence westerly on said South line a distance of 150.0 feet; <br />thence northerly on a line 75.0 feet westerly from and parallel <br />to the East line of the West Half of the Northeast Quarter of <br />said Section 13 a distance of 2,637.5 feet to a point on said <br />North line; thence easterly on said North line a distance of <br />75.0 feet to the point of beginning, containing 9.08 acres, <br />more or less, which includes 0.11 acre, more or less pre- <br />viously ' <br />viously occupied as a public highway, the remaining x.97 acres, <br />more or less, being the additional acreage to be secured in <br />this action. <br />The above described tract shall be part of a controlled <br />access facility as defined in Section 391302 (6), R.R.S. 1943, <br />and the remainder of said Northeast Quarter, which by reason <br />of the taking herein described, now abuts on a highway where <br />none existed theretofore, is subject to the provisions of <br />Section 39 -1329, R.R.S. 1943, except over the existing public <br />road along the North line of said Northeast Quarter and except <br />over one farm crossover, not to exceed 20 feet in width, de- <br />fined as two field entrances subject to the provisions of <br />Section 39 -1331, R.R.S. 1943, the centerline of which is to be <br />located 10.4 feet northerly from the South line of said North- <br />east Quarter as measured along the centerline of the highway. <br />All mineral rights in the above described tract shall be <br />retained and reserved to the Condemnees, their heirs, successors <br />or assigns. The Condemnees, their heirs, successors or assigns <br />shall have no right to use or enter the surface of the above <br />described tract for any purpose concerning the reserved mineral <br />rights; nor shall the Condemnees, their heirs, successors or <br />assigns in extracting such minerals, damage or in any way impair <br />the use of the above described tract. <br />4 r/ <br />
