C 0 N D 8 M N A T 1 0 N <br />Land Owners: Raymond Baxter and Irene Baxter, husband and <br />wife. <br />Project: F -215 (6) AFC: R -161b Hall County, Nebraska <br />Fee simple title to a tract of land and all improvements <br />thereon, if any, for highway right of way purposes located in <br />the Northwest Quarter of the Southeast Quarter of Section 13, <br />Township 11 North, Range 10 West of the 6th P.M., Hall County, <br />Nebraska, as illustrated on the attached plat and being more <br />particularly descrioed as follows: <br />Beginning at the north quarter quartet corner of the <br />Southeast Quarter of said Section 13; thence southerly on the <br />Bast line of the Northwest Quarter of the Soutneast Quarter of <br />said Section 13 a distance of 1,318.8 feet to the southeast <br />corner of said Northwest Quarter of the Southeast Quarter; <br />tnence westerly on the South line of said Northwest Quarter of <br />the Soutneast Quarter a distance of 75.0 feet; thence north- <br />erly on a line 75.0 feet westerly from and parallel to said <br />Cast line a distance of 1,318.8 feet to a point on the North <br />line of said Northwest Quarter of the Southeast Quarter; <br />thence easterly on said North line a distance of 75.0 feet to <br />the point of beginning, containing 2.27 acres, more or less, <br />to be secured in tnis action. <br />Tne above described tract snail be part of a controlled <br />access facility as defined in Section 39 -1302 (6), R.R.S. <br />1943, and the remainder of said Northwest Quarter of the South- <br />east Quarter, which by reason of the taking herein described, <br />now aouts on a highway where none existed theretofore, is sub- <br />ject to the provisions of Section 39 -13291 R.R.S. 1943. <br />--- All mineral rights in the above described tract shall be <br />retained and reserved to, the Condemnees, their heirs, successors <br />or assigns. Tle Condemnees, their heirs, successors or assigns <br />shall have no riCht to use or enter the surface of the above <br />described tract for any purpose concerning the reserved mineral <br />rights; nor shall the Condemnees, their heirs, successors or <br />assigns in extracting such minerals, damage or in any way impair <br />the use of the above described tract. <br />as <br />
