C O N D E M N A T I O N <br />Land Owner: Richard Lesh <br />Project: F -215 (6) AFE: R -161b Hall County, Nebraska <br />Fee simple title to a tract of land and all improvements <br />tnereon' if any, for highway right of way purposes located in <br />the hest Half of the Southeast Quarter of Section 320 Township <br />12 North, Range 9 West of the 6th Hall County, Nebraska, <br />as illustrated on the attached plat and being more particularly <br />described as follows: <br />Beginning at the south quarter corner of said Section: 32; <br />thence easterly on the South line of the West Half of the <br />Southeast Quarter of said Section 32 a distance of 1,322.4 <br />feet to the soutneast corner of said West Half of the Southeast <br />Quarter; thence northerly on the East line of said West half <br />of the Southeast Quarter a distance of 73.8 feet; thence west- <br />erly a distance of 1,322.4 feet to a point on the West line of <br />said West Half of the Southeast Quarter; thence southerly on <br />said West line a distance of 72,7 feet to the point of be- <br />ginning, containing 2.22 acres, more or less, which includes <br />1.00 acre, more or less, previously occupied as a public high - <br />way, the remaining 1.22 acres, more or less, being the <br />additional acreage to be secured in tnis action. <br />There will be no ingress or egress from the above des- <br />cribed tract of land onto the remainder of said West Half of <br />the Southeast Quarter, except over one field entrance, not to <br />exceed 20 feet in width, to provide for the movement of <br />farming inplements and crops so long as it is used consistent <br />with normal farming operations of the owner, the centerline of <br />which is to be located 2.5 feet easterly from tine West line of <br />said West Half of the Southeast Quarter as measured along the <br />centerline of the highwa , and except over one commercial <br />entrance, not to exceed 0 feet in width, to provide ingress <br />and egress to property of the owner so long as it is used <br />consistent witn operating normal business activities as they <br />exist, the centerline of which is to be located 100.0 feet <br />westerly from the East line of said West Half of the Southeast <br />Quarter as measured along the centerline of the highway. <br />All mineral rights in the above described tract shall be <br />retained and reserved to the Condemnee, his heirs, successors <br />or assigns. The Condemnee, his neirs, successors or assigns <br />snall nave no right to use or enter the use of the above des- <br />cribed tract for any purpose concerning the reserved mineral <br />rights; nor shall the Condem nee, his heirs, successors or <br />assigns in extracting such minerals, damage or in any way impair <br />the use of the above described tract. <br />
