a1/1z <br />If the lease is terminated pursuant to this Article VIII, <br />Lessor shall refund the proportionate part of any advance rental paid <br />for any period beyond termination date, upon ten days' notice. <br />ARTICLE IX <br />ASSIGNMENT AND SUBLETTING <br />Travelodge may'assign or sublet its interest or any part <br />thereof without securing Lessor's consent. However, no assignment or <br />subletting shall relieve Travelodge or its successors in interest from <br />liability for the performance of its obligations hereunder. <br />ARTICLE X <br />REMEDIES <br />Section 1. Defaults. Lessor may terminate this lease upon <br />the happening of any one of the following events: (a) failure of <br />Travelodge to pay an installment of rent then due within fifteen days <br />after notice; (b) failure of Travelodge to perform any otter covenant <br />of the lease within thirty days after notice; (c) failure of Travelodge <br />to-maintain the mortgage on the premises in good standing and, in the <br />event of default, to reinstate the mortgage within thirty days of notice <br />from the mortgagee or Lessor; (d) the making by Travelodge of an assign- <br />ment for the benefit of its creditors; (e) the levying of a writ of ex- <br />ecution or attachment on or against the property of Travelodge if not <br />released or discharged within thirty days thereafter; (f) the institu- <br />tion of proceedings in a court of competent jurisdiction for the in- <br />voluntary dissolution of Travelodge, or for its adjudication as a bank- <br />rupt or insolvent, if such proceedings are not dismissed and any trustee <br />or liquidator appointed therein discarged within sixty days after the <br />institution thereof. <br />Section 2. Re- entry. Upon the termination of this lease <br />(whether by lapse of time or otherwise), Lessor may re -enter the <br />premises, and, using such force as may be necessary, remove all persons <br />and chattels therefrom. Travelodge shall remain liable upon any mort- <br />gage .,r other debt required to be paid by Travelodge under,this lease <br />which is a lien against the premises, repay the same and hold Lessor <br />harmless in re8pect thereto. <br />'Al ,� <br />
