A F F I D A V-1 T <br />STATE OF NEBRASKA ) <br />ss. <br />COUNTY OF HALL. ) <br />Evelyn Diekman, being first duly sworn, says <br />I am one of the owners of Lot One (1) on the-Main Land of <br />the SWIA of SE'/ of Sec. 140 T 11.14, R 9 W 6th P.M. and a_ party <br />to transactions, commencing. in 19551 with M.M. Lippincott and <br />the Estate of Marmion Moses Lippincott, deceased, regarding the <br />lease agreement recorded in Book U on page 475 of records in the <br />office of the Register of Deeds of Hall County, Nebraska. <br />On about November 21 , 1956, affiant and the other owners of <br />such real property consumated the settlement with the Estate of <br />such M.M. Lippincott, deceased, add the residuary devisee therein, <br />whereunder and whereby such lease agreement was subsequently fully <br />and finally terminated through removal of machinery, equipment, <br />bins, buildings and trackage from such real property prior to <br />August 9, 1957 and possession thereof was surrendered to affiant. <br />and the other owners. <br />The assigns of such deceased lessee,,further, have neither <br />paid nor tendered any rentals subsequent to the rental for the <br />lease year ending August 99 1957 or made any performance under <br />such lease agreement or claimed any right of occupancy or use <br />of such real property subsequent to August 9, 1957. <br />Dorothy Sievers, a devisee of Detlef Stelk and this <br />affiant are sisters.
