5 <br />all valid Federal, state, county and municipal laws, rules, regulations <br />and ordinances affecting the Properties or the use thereof. <br />Lessee covenants to furnish to Lessor upon written demand by <br />Lessor proof of the payment of any tag, assessment, imposition or <br />other similar charge or claim upon or against any Property that is <br />payable by Lessee as in this Section 9 provided. <br />10. Indemnification and Insurance. <br />(A) Lessee shall protect, indemnify and save harmless Lessor <br />from and against: (1) any and all liability, damage, expense, causes <br />of action, suits, claims, demands or judgments of any nature what- <br />soever arising from injury to persons or property on any Property, <br />or in any manner growing out of or connected with the use and <br />occupancy of any Property or resulting from the condition of any <br />Property during the term of this Lease, and (2) any liability for <br />violation of conditions, agreements, restrictions, laws, ordinances or <br />regulations affecting any Property or the ownership, occupancy or <br />use thereof. <br />(B) Lessee, at its expense, will insure such portion (which may be <br />all) of the Properties as is customarily insured by companies engaged <br />in the same business and similarly situated, against all such casualties, <br />contingencies and liabilities as are customarily insured against by such <br />other companies, and in such types and amounts as are customarily <br />carried under similar circumstances by such other companies. All such <br />insurance shall be effected under valid and enforceable policies issued <br />by insurers of recognized responsibility. Partial self - insurance and /or <br />the use of deductibles is permitted to the extent in conformity with the <br />insurance coverage described above. The Lessee shall be entitled to <br />receive and appropriate to its own use the entire proceeds paid under <br />any insurance policies referred to in this Section 10(B). <br />(C) Should any_mechanics' liens at any time during the term of <br />this Lease be contracted or caused or permitted by Lessee to be filed <br />against any Property then subject hereto, Lessee shall cause the same <br />to be discharged of record or bonded with a surety company, in an <br />amount satisfactory to Lessor, within forty days after actual actual notice <br />is received by Lessee of the filing of the same. <br />. 1 ii 6 n n,u!,,1 Oi I „, i l61 IIm1IdIiliill� <br />li <br />
