4 <br />howevc -r, that Lesz ee shall have the right at any time to remove froin <br />any Property and di -Dose of, free of any right or claim of Lessor, equip - <br />mcnt c•xi -tin" and covered by this Lease at the effective date hereof or <br />substituted for equipment so existing and covered which, in the opinion <br />of Lessee, are worn out or obsolete or not essential to the efficient oper- <br />ation of such Property, without Substituting like equipment therefor, <br />if the market value of such Property at such time is not thereby sub- <br />stantially less(-ned. For the purposes of this Lease, such substitute <br />buildings or equipment Shall, on any date, be deemed to have the same <br />projected depreciated net book value (as hereinafter defined) as the <br />buildings or c- quipment for which they were substituted had or, but <br />for such substitution, ~could have had on such date. <br />7. Dcstructi.on or Duraage. If, during the terin hereof, any itu- <br />provements upon any Property Shall be destroyed or damaged from <br />any cause, Lessee ,ball have the right, but, Subject to Section 15, -hall <br />not be obligated, to rebuild or repair the same at its uwn riA and <br />expense. Lessor Shall be under no obligation to rebuild, replace, <br />maintain or make any repairs to any such iunproveinents, but the <br />rentals ,hall not be abated, deferred or dimini,hed as the re -ult of <br />damage to, or destruction of, any such iial4ovements. For the pur- <br />poses of this Lease, ,uc•h Property shall thereafter have the same pro- <br />jected depreciated net book value (as hereinafter defined) as it could <br />have had but for such destruction or damage. <br />S. .11aintenance. Lessee acknowledges that it has received the <br />Properties in good order and condition and, subject to the provisions <br />of Sections G, 7 and 11, Shall keep them in the same order and condition, <br />ordinary sear and tear excepted, during the term hereof. <br />9. Tares and Other Charges. Lessee shall pay and discharge, as <br />additional rent, as and when the sarne ,shall become due and payable, <br />without penalty, all taxes, assessments, impositions or other similar <br />charges or claims assessed against, or become due and payable with <br />respect to, or become liens upon or against, the Properties or the leasing <br />of the Properties hereunder or this Lease or any business upon the <br />Properties. Lessee, its assignees and sub - lessees shall comply with <br />
