3 <br />nant, representation or warranty as to the estate, right, title or interest <br />of Lessor in and to the Properties or as to any liens, encumbrances or <br />charges thereon, and if the possession or use of the Properties by <br />Lessee is prevented or otherwise disturbed as the result of a failure of <br />or defect in Lessor's right, title or interest in or to any part of the <br />Properties, or as a result of the enforcement of any lien or encum- <br />brance on the Properties, or for any other reason, or if the use of the <br />Properties or any part thereof shall be restricted or prohibited by any <br />law, ordinance, injunction, regulation, order or other interference, <br />Lessor shall have no liability to Lessee therefor, this Lease shall not <br />terminate, Lessee shall not be entitled to surrender the Properties or <br />to any abatement or reduction of rent, and the obligations of Lessee <br />hereunder shall not be otherwise affected thereby, any present or future <br />law to the contrary notwithstanding. The agreements of Lessee con- <br />tained in this Section 4 are made, among other considerations, in the <br />light of the warranty of title given to Lessor by Lessee or its affiliate <br />by deeds to the Properties and the covenants of Lessee herein con- <br />tained, but shall not be affected by any unenforceability of any such <br />warranty or covenant. <br />5. Use of Properties. Lessor agrees that Lessee may use and <br />occupy the Properties for any lawful business purpose whatsoever, <br />and Lessee agrees that it will not use or occupy, and will not permit the <br />use or occupancy, of any Property in violation of any covenant, condi- <br />tion or restriction contained in any instrument of record affecting such <br />Property. <br />6. Alterations, Additions and Substitutions. Lessee shall have the <br />right at any time during the term hereof to erect such equipment, facili- <br />t es Qr imp�oven�ents on any P� op�ity a�, it may se.__ t,.tQ inst,jl Q� <br />in any Property additional equipment or facilities, and to alter, remove <br />and dispose of them at will. Lessee shall have the right at any time to <br />remove from any Property and dispose of, free of any right or claim <br />of Lessor, any buildings or equipment covered by this Lease on the <br />date the term of this Lease commences or substituted for buildings or <br />equipment so covered, upon substituting therefor other buildings or <br />equipment of substantially the same then net book value; provided, <br />_V_3 <br />
