20/304892 <br />13. Waste Collection <br />Trash must be kept free and clear of water and yards. The Developer has the right to <br />give written notice upon finding trash in the lake or on residential lots and the <br />homeowner must clear within a reasonable time period of no less than forty eight hours <br />or Developer has the right to collect and bill said homeowner per occasion for <br />collection. <br />14. Safety <br />Each homeowner is responsible for his /her individual safety, for their families and <br />friends safety and for others who claim to have entered with said individuals. <br />Swimming is "at your own risk" and should never be without life vests and with <br />qualified supervision. Developer takes no responsibility for swimming accidents. <br />15. Residential House Sizes and Outbuildings <br />Each residential lot shall have approximately no less than 2500 of finished square feet <br />per home located on them. All residential homes must have stone or brick located on <br />the front side of each residence covering i/4 of the residential home. <br />16. Watercraft and Swimming areas <br />No watercraft 25' and larger are permitted on lake. Permitted swimming areas in front <br />of your residential lot are allowed through request and entirely by permission of the <br />Developer and again can be revoked at any time. For safety reasons watercraft must be <br />able to visually define designated swimming areas from non - designated swimming <br />areas. Floating buoys are recommended to safely provide areas for swimming. <br />17. Any owner of any lot , or their heirs, devisees, personal representatives, successors, <br />assigns or grantees, in said Ummel Subdivision in the City of Grand Island, Hall <br />County, Nebraska, shall be subject to a these RESTRICTIVE COVENANTS AND <br />CONDITIONS and run with land and shall be binding on all persons and all parties <br />claiming ownership of said lots permanently with purchase and ownership of said lots. <br />18. If any of the restrictive covenants, restrictions or conditions herein set forth are <br />violated and declared void by a court of competent jurisdiction, the remaining <br />restrictive covenants, restrictions, and conditions shall not be affected, but shall stay <br />and remain in full force and effect. <br />19. If any owner of any lot, or their heirs, devisees, personal representatives, successors, <br />assigns or grantees, shall violate any of the restrictive covenants, restrictions and <br />conditions herein set forth, it shall be lawful for any person or persons owning any real <br />estate in said subdivision to prosecute such proceedings at law or in equity against the <br />person or persons violating or attempting to violate any such restrictive covenants, <br />restrictions or conditions and to preven im fro) 'so doing o recover damages for <br />such violations. <br />DATE: —� r.- <br />State of Nebraska <br />County of Hall <br />The foregoing instrustment was acknowledged before me June 18, 2013 by <br />Tonmy L.
