ARTICLE I CONFIRMATION AND INCORPORATION OF TERMS OF INDENTURE. 3 201204004 PROVIDED, HOWEVER, that if the Corporation, its successors or assigns shall well and truly pay, or cause to be paid, the principal of the Bonds and interest due or to become due thereon, at the times and in the manner mentioned in the Bonds, according to the true intent and meaning thereof, and shall make the payments into the Bond Fund as required under Article V and shall well and truly keep, perform and observe all the covenants and conditions pursuant to the terms of this Third Supplemental Trust Indenture and Security Agreement to be kept, performed and observed by it, and shall pay or cause to be paid to the Trustee all sums of money due or to become due to it in accordance with the terms and provisions hereof, then upon such fmal payments this Third Supplemental Trust Indenture and Security Agreement and the rights hereby granted shall cease, determine and be void; otherwise this Third Supplemental Trust Indenture and Security Agreement to remain in full force and effect. THIS THIRD SUPPLEMENTAL TRUST INDENTURE AND SECURITY AGREEMENT FURTHER WITNESSETH: That all Bonds issued hereunder are to be issued, authenticated and delivered, and all said revenues, income and other property hereby pledged are to be dealt with and disposed of under, upon and subject to the terms, conditions, trusts, uses and purposes hereinafter expressed, and the Corporation has agreed and covenanted and does hereby agree and covenant with the Trustee and with the respective owners, from time to time, of the Bonds, as follows, that is to say: Section 1. The Corporation and the Trustee hereby confirm with respect to the Series 2013 Bonds herein authorized that the Series 2013 Bonds are being issued as Refunding Bonds as defined in the Original Indenture. All terms of the Original Indenture relating to Bonds, as defmed in the Original Indenture, shall apply to the Series 2013 Bonds. All of the terms and conditions of the Original Indenture, except to the extent modified by the express terms of this Third Supplemental Trust Indenture and Security Agreement, are hereby confirmed and incorporated by reference and this Third Supplemental Trust Indenture and Security Agreement shall constitute a "supplemental indenture" as described and referred to in of the Original Indenture. All terms defmed in the Original Indenture either by parenthesis or in Article I thereof shall have the same meanings herein as are set forth in the Original Indenture except to the extent modified in Sections 2 of this Article I. Section 2. For purposes of this Third Supplemental Trust Indenture and Security Agreement and the Original Indenture the following additional terms shall have the following meanings, unless the context shall clearly indicate some other meaning, to -wit: "additional bonds" - any bonds issued hereunder other than the Series 2009A Bonds, Series 2009B Bonds, Series 2009C Bonds and Series 2013 Bonds. "Bond" or "Bonds" - any bond or bonds currently outstanding and issued pursuant to, in accordance with and secured by the Original Indenture as supplemented, including the Series 2009C Bonds, Series 2013 Bonds and any additional Refunding Bonds. "2013 Construction Fund" - the Construction and Acquisition Fund established with the Trustee under the terms of Section 1 of Article V of this Third Supplemental Trust Indenture and Security Agreement.
