and ORDINANCE NO. 268 201304209 AN ORDINANCE TO EXTEND THE BOUNDARIES AND INCLUDE WITHIN THE CORPORATE LIMITS OF, AND TO ANNEX INTO, THE VILLAGE OF ALDA, NEBRASKA, A TRACT OF LAND COMPRISING PART OF LOT 13, COUNTY SUBDIVISION OF THE NW1 /4 AND Wl /2NE1 /4 OF SECTION 5, TOWNSHIP 10 NORTH, RANGE 10 WEST OF THE 6th P.M., ALONG WITH ALL ADJOINING PUBLIC RIGHT -OF- WAY IN HALL COUNTY, NEBRASKA, AS MORE PARTICULARLY DESCRIBED HEREINAFTER AND AS SHOWN ON EXHIBIT "A" ATTACHED HERETO; TO PROVIDE SERVICE BENEFITS THERETO; TO REPEAL ANY ORDINANCE OR RESOLUTIONS OR PARTS THEREOF IN CONFLICT HEREWITH; AND TO PROVIDE THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, upon referral by the Village of Alda for recommendations, and after public hearing on November 7, 2012, the Hall County Regional Planning Commission recommended the approval of annexing the following tract of land into the Village of Alda: A parcel of land located in Lot 13, County Subdivision of the NW1/4 and W1/2NE1/4 of Section 5, Township 10 North, Range 10 West of the Sixth P.M., Hall County, Nebraska, being described as follows: Beginning at the Northeast Corner of Lot 2, Leon Subdivision; thence northerly on the West Line of Lot 13, County Subdivision of the NW1/4 and W' /ZNE' /4 of Section 5 to the Northwest Corner of said Lot 13; thence northeasterly on the North Line of said Lot 13 and on the Southeasterly Right -of -Way Line of the Union Pacific Railroad to the Northwest Corner of Lot 2, Crumrine Subdivision; thence southerly on the West Line of said Lot 2, a distance of 107 feet to the Northwest Corner of Lot 2, Crumrine Second Subdivision; thence southerly on the West Line of Lot 2 of said Crumrine Second Subdivision, a distance of 90 feet; thence westerly on said West Line, a distance of 113 feet; thence southerly on said West Line, a distance of 150 feet to the Southwest Corner of said Lot 2 and the Northwest Corner of Lot 1 of said Crumrine Second Subdivision; thence southerly on the West Line of said Lot 1, a distance of 150 feet to the Southwest Corner of said Lot 1 and the Northwest Corner of Lot 2, Argo Fifth Addition; thence southerly on the West Line of said Lot 2 to the Point of Beginning; WHEREAS, following a public hearing by the Village of Alda upon the recommendation of the Regional Planning Commission this Ordinance has now been read by title on three different days, following which reading it was duly moved and seconded for passage. BE IT ORDAINED BY THE CHAIRPERSON AND BOARD MEMBERS OF THE VILLAGE OF ALDA, NEBRASKA: Section 1. It is hereby found and determined that: (A) The above - described tract of land is urban or suburban in character, and the subject properties are contiguous or adjacent to the corporate limits of the Village of Alda, Nebraska. (B) Upon annexation to the Village, the subject lands will receive the material benefits and advantages currently provided to land within the Village's corporate limits, including but not limited to police, fire, emergency services, street maintenance, and utilities services , and Village water and sanitary sewer service is available or will be made available as provided by law.
