ORDINANCE NO. 266 <br />201304207 <br />AN ORDINANCE TO EXTEND THE BOUNDARIES AND INCLUDE WITHIN THE <br />CORPORATE LIMITS OF, AND TO ANNEX INTO, THE VILLAGE OF ALDA, <br />NEBRASKA, A TRACT OF LAND EAST OF ALDA ROAD, SOUTH OF ARGO <br />SUBDIVISION, WEST OF SATURN STREET, NORTH OF LUNAR AVENUE, WEST OF <br />ARGO FOURTH SUBDIVISION, AND NORTH OF WILDWOOD DRIVE, ALONG WITH <br />ALL ADJOINING PUBLIC RIGHT -OF -WAY IN HALL COUNTY, NEBRASKA, AS MORE <br />PARTICULARLY DESCRIBED HEREINAFTER AND AS SHOWN ON EXHIBIT "A" <br />ATTACHED HERETO; TO PROVIDE SERVICE BENEFITS THERETO; TO REPEAL ANY <br />ORDINANCE OR RESOLUTIONS OR PARTS THEREOF IN CONFLICT HEREWITH; AND <br />TO PROVIDE THE EFFECTIVE DATE OF THIS ORDINANCE. <br />WHEREAS, upon referral by the Village of Alda for recommendations, and after public <br />hearing on November 7, 2012, the Hall County Regional Planning Commission recommended <br />the approval of annexing the following tract of land into the Village of Alda: <br />A parcel of land located in the Southwest Quarter of Section 5, Township 10 <br />North, Range 10 West of the Sixth P.M., Hall County, Nebraska, being described <br />as follows: Beginning at the Southwest Corner of the Southwest Quarter of <br />Section 5; thence northerly on the West Line of said Southwest Quarter to the <br />westerly extension of the South Line of Lot 11, Argo Subdivision; thence easterly <br />on said westerly extension to the Southwest Corner of said Lot 11; thence easterly <br />on the South Line of Lots 10 and 11 of said Argo Subdivision to the Southeast <br />Corner of said Lot 10; thence southerly on the West Right -of -Way Line of Saturn <br />Street to the North Right -of -Way Line of Lunar Avenue; thence westerly on said <br />North Right -of -Way Line to the East Line of Lot 1, P.V. Vet Subdivision; thence <br />southerly on said East Line to the Southeast Corner of said Lot 1; thence southerly <br />on the West Line of Argo Fourth Addition to the Southwest Corner of Lot 22 of <br />said Argo Fourth Addition; thence southerly on the southerly extension of the <br />West Line of said Lot 22, a distance of 40 feet to the South Line of said <br />Southwest Quarter; thence westerly on said South Line to the Point of Beginning. <br />and <br />WHEREAS, following a public hearing by the Village of Alda upon the recommendation <br />of the Regional Planning Commission this Ordinance has now been read by title on three <br />different days, following which reading it was duly moved and seconded for passage. <br />BE IT ORDAINED BY THE CHAIRPERSON AND BOARD MEMBERS OF THE <br />VILLAGE OF ALDA, NEBRASKA: <br />Section 1. It is hereby found and determined that: <br />(A) The above- described tract of land is urban or suburban in character, and the <br />subject properties are contiguous or adjacent to the corporate limits of the Village <br />of Alda, Nebraska. <br />(B) Upon annexation to the Village, the subject lands will receive the material <br />benefits and advantages currently provided to land within the Village's corporate <br />limits, including but not limited to police, fire, emergency services, street <br />maintenance, and utilities services , and Village water and sanitary sewer service <br />is available or will be made available as provided by law. <br />
