ORDINANCE NO. 266 201304207 AN ORDINANCE TO EXTEND THE BOUNDARIES AND INCLUDE WITHIN THE CORPORATE LIMITS OF, AND TO ANNEX INTO, THE VILLAGE OF ALDA, NEBRASKA, A TRACT OF LAND EAST OF ALDA ROAD, SOUTH OF ARGO SUBDIVISION, WEST OF SATURN STREET, NORTH OF LUNAR AVENUE, WEST OF ARGO FOURTH SUBDIVISION, AND NORTH OF WILDWOOD DRIVE, ALONG WITH ALL ADJOINING PUBLIC RIGHT -OF -WAY IN HALL COUNTY, NEBRASKA, AS MORE PARTICULARLY DESCRIBED HEREINAFTER AND AS SHOWN ON EXHIBIT "A" ATTACHED HERETO; TO PROVIDE SERVICE BENEFITS THERETO; TO REPEAL ANY ORDINANCE OR RESOLUTIONS OR PARTS THEREOF IN CONFLICT HEREWITH; AND TO PROVIDE THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, upon referral by the Village of Alda for recommendations, and after public hearing on November 7, 2012, the Hall County Regional Planning Commission recommended the approval of annexing the following tract of land into the Village of Alda: A parcel of land located in the Southwest Quarter of Section 5, Township 10 North, Range 10 West of the Sixth P.M., Hall County, Nebraska, being described as follows: Beginning at the Southwest Corner of the Southwest Quarter of Section 5; thence northerly on the West Line of said Southwest Quarter to the westerly extension of the South Line of Lot 11, Argo Subdivision; thence easterly on said westerly extension to the Southwest Corner of said Lot 11; thence easterly on the South Line of Lots 10 and 11 of said Argo Subdivision to the Southeast Corner of said Lot 10; thence southerly on the West Right -of -Way Line of Saturn Street to the North Right -of -Way Line of Lunar Avenue; thence westerly on said North Right -of -Way Line to the East Line of Lot 1, P.V. Vet Subdivision; thence southerly on said East Line to the Southeast Corner of said Lot 1; thence southerly on the West Line of Argo Fourth Addition to the Southwest Corner of Lot 22 of said Argo Fourth Addition; thence southerly on the southerly extension of the West Line of said Lot 22, a distance of 40 feet to the South Line of said Southwest Quarter; thence westerly on said South Line to the Point of Beginning. and WHEREAS, following a public hearing by the Village of Alda upon the recommendation of the Regional Planning Commission this Ordinance has now been read by title on three different days, following which reading it was duly moved and seconded for passage. BE IT ORDAINED BY THE CHAIRPERSON AND BOARD MEMBERS OF THE VILLAGE OF ALDA, NEBRASKA: Section 1. It is hereby found and determined that: (A) The above- described tract of land is urban or suburban in character, and the subject properties are contiguous or adjacent to the corporate limits of the Village of Alda, Nebraska. (B) Upon annexation to the Village, the subject lands will receive the material benefits and advantages currently provided to land within the Village's corporate limits, including but not limited to police, fire, emergency services, street maintenance, and utilities services , and Village water and sanitary sewer service is available or will be made available as provided by law.
