ORDINANCE NO. 271 <br />201304205 <br />AN ORDINANCE TO EXTEND THE BOUNDARIES AND INCLUDE WITHIN THE <br />CORPORATE LIMITS OF, AND TO ANNEX INTO, THE VILLAGE OF ALDA, <br />NEBRASKA, A TRACT OF LAND LOCATED SOUTH OF PRAIRIELAND SUBDIVISION <br />AND THE EXTENSION OF THE SOUTH BOUNDARY LINE OF PRAIRIELAND <br />SUBDIVISION TO SATURN STREET, AND NORTH OF A -G ACRES SECOND AND <br />THIRD SUBDIVISIONS AND PART OF LOT THREE (3), ARGO SECOND SUBDIVISION, <br />IN THE SOUTHWEST QUARTER OF SECTION 5, TOWNSHIP 10 NORTH, RANGE 10 <br />WEST OF THE 6`" P.M., ALONG WITH ALL ADJOINING PUBLIC RIGHT -OF -WAY IN <br />HALL COUNTY, NEBRASKA, AS MORE PARTICULARLY DESCRIBED HEREINAFTER <br />AND AS SHOWN ON EXHIBIT "A" ATTACHED HERETO; TO PROVIDE SERVICE <br />BENEFITS THERETO; TO REPEAL ANY ORDINANCE OR RESOLUTIONS OR PARTS <br />THEREOF IN CONFLICT HEREWITH; AND TO PROVIDE THE EFFECTIVE DATE OF <br />THIS ORDINANCE. <br />WHEREAS, upon referral by the Village of Alda for recommendations, and after public <br />hearing on November 7, 2012, the Hall County Regional Planning Commission recommended <br />the approval of annexing the following tract of land into the Village of Alda: <br />A parcel of land located in the Southwest Quarter of Section 5, Township 10 <br />North, Range 10 West of the Sixth P.M., Hall County, Nebraska, being described <br />as follows: Beginning at the Southwest Corner of Lot 1, Prairieland Subdivision; <br />thence easterly on the South Line of said Lot 1, a distance of 705.33 feet to the <br />Southeast Corner of said Lot 1; thence southerly on the southerly extension of the <br />East Line of said Lot 1 to the North Line of Lot 3, Argo Second Subdivision; <br />thence westerly on the North Line of said Lot 3 to the Northwest Corner of said <br />Lot 3; thence southerly on the West Line of said Lot 3, a distance of 10.0 feet to <br />the Northeast Corner of Lot 4, A -G Acres Third Subdivision; thence westerly on <br />the North Line of Lots 1 through 4 of said A -G Acres Third Subdivision, a <br />distance of 718.62 feet to the Northwest Corner of said Lot 1; thence northerly <br />parallel with and 230 feet distant from the West Right -of -Way Line of Saturn <br />Street, a distance of 752.29 feet; thence westerly parallel with and 1,112.29 feet <br />distant from the South Line of the Southwest Quarter of Section 5 to the East <br />Right -of -Way Line of Saturn Street; thence northerly on said East Right -of -Way <br />Line to the Southwest Corner of a parcel of land described and recorded in <br />Document Number 200810199; thence easterly on the South Line of said parcel, a <br />distance of 210.0 feet to the Point of Beginning; <br />and <br />WHEREAS, following a public hearing by the Village of Alda upon the recommendation <br />of the Regional Planning Commission this Ordinance has now been read by title on three <br />different days, following which reading it was duly moved and seconded for passage. <br />BE IT ORDAINED BY THE CHAIRPERSON AND BOARD MEMBERS OF THE <br />VILLAGE OF ALDA, NEBRASKA: <br />Section 1. It is hereby found and determined that: <br />(A) The above - described tract of land is urban or suburban in character, and the <br />subject properties are contiguous or adjacent to the corporate limits of the Village <br />of Alda, Nebraska. <br />(B) Upon annexation to the Village, the subject lands will receive the material <br />benefits and advantages currently provided to land within the Village's corporate <br />
