AN ORDINANCE TO EXTEND THE BOUNDARIES AND INCLUDE WITHIN THE CORPORATE LIMITS OF, AND TO ANNEX INTO, THE VILLAGE OF ALDA, NEBRASKA, A TRACT OF LAND COMPRISING ALL OF LOTS ONE (1) AND TWO (2) OF PRAIRIELAND SUBDIVISION LOCATED IN THE SOUTHWEST QUARTER OF SECTION 5, TOWNSHIP 10 NORTH, RANGE 10 WEST OF THE 6 P.M., ALONG WITH ALL ADJOINING PUBLIC RIGHT -OF -WAY IN HALL COUNTY, NEBRASKA, AS MORE PARTICULARLY DESCRIBED HEREINAFTER AND AS SHOWN ON EXHIBIT "A" ATTACHED HERETO; TO PROVIDE SERVICE BENEFITS THERETO; TO REPEAL ANY ORDINANCE OR RESOLUTIONS OR PARTS THEREOF IN CONFLICT HEREWITH; AND TO PROVIDE THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, upon referral by the Village of Alda for recommendations, and after public hearing on November 7, 2012, the Hall County Regional Planning Commission recommended the approval of annexing the following tract of land into the Village of Alda: A parcel of land located in the Southwest Quarter of Section 5, Township 10 North, Range 10 West of the Sixth P.M., Hall County, Nebraska, being described as follows: Beginning at the Southwest Corner of Lot 1, Prairieland Subdivision; thence northerly on the West Line of Lot 1, a distance of 553.04 feet to the Northeast Corner of Lot 7, Elrod Estates Subdivision; thence northwesterly on the North Line of said Lot 7, a distance of 114.28 feet; thence westerly on said North Line, a distance of 109.63 feet to the Northwest Corner of said Lot 7; thence northerly on the East Right -of -Way Line of Saturn Street, a distance of 59.89 feet to the Southwest Corner of Lot 6 of said Elrod Estates Subdivision; thence easterly on the South Line of said Lot 6, a distance of 125.06 feet; thence southeasterly on said South Line, a distance of 39.91 feet to the Southeast Corner of said Lot 6; thence northerly on the East Line of Lots 1 through 6 of said Elrod Estates Subdivision, a distance of 547.01 feet to the Northeast Corner of said Lot 1; thence easterly on the North Line of Lot 1 of said Prairieland Subdivision, a distance of 751.03 feet to the Northeast Corner of said Lot 1, thence southerly on the East Line of said Lot 1, a distance of 1,193.43 feet to the Southeast Corner of said Lot 1; thence westerly on the South Line of said Lot 1, a distance of 705.33 feet to the Point of Beginning; ORDINANCE NO. 269 2 01304203 WHEREAS, following a public hearing by the Village of Alda upon the recommendation of the Regional Planning Commission this Ordinance has now been read by title on three different days, following which reading it was duly moved and seconded for passage. BE IT ORDAINED BY THE CHAIRPERSON AND BOARD MEMBERS OF THE VILLAGE OF ALDA, NEBRASKA: Section 1. It is hereby found and determined that: (A) The above - described tract of land is urban or suburban in character, and the subject properties are contiguous or adjacent to the corporate limits of the Village of Alda, Nebraska. (B) Upon annexation to the Village, the subject lands will receive the material benefits and advantages currently provided to land within the Village's corporate limits, including but not limited to police, fire, emergency services, street maintenance, and utilities services , and Village water and sanitary sewer service is available or will be made available as provided by law.
