<br />The undersigned, Arend R. Baack, Successor Trustee under a certain Deed of Trust dated
<br />May 28, 2009, wherein NEW PARADIGM REALTY, INC., a California Corporation, is the
<br />Trustor, which was filed for record on June 2, 2009, as Instrument No. 200904298, and thereafter
<br />assigned by those Assignments filed of record on June 2, 2009, as Instrument No. 200904299; on
<br />February 15, 2011, as Instrument No. 201101287; and on August 2, 2011, as Instrument No.
<br />201105737, in the office of the Register of Deeds of Hall County, Nebraska, and contains as trust
<br />property the following- described real estate:
<br />Lot One (1), Concept Second Subdivision, in the City of Grand Island, Hall
<br />County, Nebraska;
<br />which is commonly known as 1515 East 4 Street, Grand Island, Nebraska;
<br />together with all existing or subsequently erected or affixed buildings, improvements and
<br />fixtures; and all easements, rights of way, and appurtenances; all water and water rights; and all
<br />other rights, royalties, and profits relating to the real property, including without limitation such
<br />rights as Trustor may have in all minerals, oil, gas, geothermal and similar matters, all of which
<br />was referred to in such Deed of Trust as the "Property ";
<br />hereby gives notice of default of said Trustor for the reason that said Trustor has failed to make
<br />the payments of principal and interest now due in its entirety in respect to the Promissory Note
<br />secured by that Deed of Trust, as the same had been modified and deferred pursuant to a
<br />Forbearance Agreement dated May 28, 2011, and a First Amendment to Forbearance Agreement
<br />dated September 30, 2012; and said Trustor has also failed to pay real estate taxes due for the
<br />second half of 2011 and the first half of 2012.
<br />By reason of such default, the undersigned Successor Trustee hereby elects to sell or
<br />cause to be sold the above Property to satisfy the obligations of that certain Promissory Note
<br />dated May 28, 2009, owing from Trustor to the Successor Beneficiary, MFC NEW PARADIGM
<br />LLC, pursuant to the terms of the above - referenced Deed of Trust, which secures this obligation.
