<br /> (h) that the Dwelling Units in the Project shall be leascd and rented to members of the
<br /> general public ia eompliance with the Coda and this Agreement, except for any units rented under the
<br /> huusing program pursusnt to Section 8 of the Unised States �Iousing Act of 1937, as amended, which
<br /> will be leased to eligible tenants in accordance with the constraints and regulatinns of such hou�ing
<br /> program;
<br /> (i) that the Project shall consist of one ar more proximate buildings or suuctures tocated un
<br /> a single tract of land which have sirailarly constructed units financed pursuant to a common plan(unless
<br /> the Project qualifies as a scattered site project under Se�t�on 42(g)(7) of the Code), tagether with
<br /> fuacaonally nlated and subordinat�facilitles wluch shall be owned by the Owner or a Relaud Personf
<br /> (j) that the Owner shall. not discriminate on the basis o� race, crad� wlor, sex, age,
<br /> handicap, marltal status or natlonal origin in the lease, use or occupancy of the Project or in
<br /> em�loyment of persons for the operation and management of tbe Project;
<br /> (k) that the Owner will accept as tenants, on the same basis as all other prospecdve tenants,
<br /> persons who are holders of vouchers or certificates for federal housing assistance paymeats for existing
<br /> housing pwrsuant to Section S of the United States Housing Aci of 1937 or a successor federal pro8ram,
<br /> and, in connection therewith, the Owner will not apply tenant selection crlteda to s�sch voucher or
<br /> cxriiii�at���1d�rs w�:ch are moze bttrsle�rnP An the criteria gpplied to anY other prospecdve tenants;
<br /> (1) that the Owner will not discriminate against prospective tenants on t]�ee basis of their
<br /> receipt of,or eligibiliry for,housing assistance under any fed�ral. state or local program or on the basis
<br /> ihat they have a rainor child or children l�ving with them;
<br /> (m) that the Owner wlll not knowingly take or permit to be taken any acdon which would
<br /> have the effect. direcdy or indit+ectly, of subjecting the Owner of the Project to noncompliance with
<br /> Section 42 of th�C9de and the Regulations;
<br /> (a) that the Owner may sell, transfer or exchange the entire Projxt at any time, but tt�
<br /> Owner shall notlfy in writin8 ancl obtain the agreement of any buyer or successor or other pecson
<br /> acquiring the Project or any interest therein that such acquisition is subject to the requiremet►ts of this
<br /> Agroement. The Owner shall promptly notify the Authority of such t�ansfer. This provision shall not
<br /> act to waive any other restriction on such sale, uansfer or exchange; and
<br /> (o) that the Owner(or its property manager with respect to the Pcoject) shal� auend in ea�h
<br /> year of the Quali�ed Project PerIod at least one of the property managemendcompliance monitoring
<br /> sessions sponsored by the Authorlty.
