<br /> are single parents and their children, provided such occug�ants are not dependents of another person or(iv)by
<br /> ftill-time students wha are married and file a joint return. The determination of whether an individu�l or family
<br /> fs a Qualified Tenant shall be made at least annually on the basis of the current inzome of such accupants. Any '
<br /> unit occupied by an individual or family who is a Qualified Tenant at the commencement of occupancy shall
<br /> continue to be treated as if occupied by a Qualified Tenant, provided that, should such Quali�ed Tenant's
<br /> income subsequently exceed 1409b of the applicable income limit, such tenant shall n� longer be a Qualified
<br /> Tenant if, aRer such deternaination of income, but prlor to the next determinadon, any residendal unit of
<br /> comparable or smaller size is rentai to a tenant who is not a Qualified Tenant.
<br /> "Qua1{f'red Un�t"means a residendal unit in the Project designated for c�ccupancy by Qualified Tenants.
<br /> "Related Pe�sons" means two or more persons related within the meaning of Secdon 147(a)(2)of the
<br /> Code, including, but not limited to� familial and uust relationships. actual or attributed partnership interests,
<br /> related corporadons and certain corporate shareholders.
<br /> "Rent Restricted Un�t" means a Dwelling Unit if the gross rent with respect to the Dwelling Unit does
<br /> not exceed 30°b of the imputed income limitadon applicable to such Dwelling Unit(based on the munber af
<br /> bedrooms thereia in accordance with Sectioa 42(g)(2)(C)of the Code).
<br /> "Reguired Number of Years" means the number of years aft�r the Occupancy Date on wlaich the
<br /> QuaUfied Project Period expires and as set forth on the Summary Page.

<br /> representations and warrandes W induce the Authority to enter into this Agreement ancl further represents,
<br /> warrants and covenants that:
<br /> (a) The Owner(i)is a legal organizadon as described on the Summary Page hereof org�niud
<br /> under the laws of the State identified on the Summary Page thereof, and is qualified to t�ansact business
<br /> under tt�e laws of the State of Nebraska,(ii)has the power and authoriry to own its properties and assets
<br /> and to carry on its business as now being conducted (and as contemplated by this Agreement) and
<br /> (iii)has the full legal right, power and authority to execute and deliver this Agreement and to perform
<br /> all tl�ee uadertakings of the Owner hercuader.
<br /> (b) The execution and perforaiance of this Agreement by the Owaer (i)wIll not violate or;
<br /> as applicable, have not violated any provision of law, rule or nguladon, or any order of aay aourt or
<br /> other agency or governmental body, (u) will not violate or, as applicable, have not violatal any _
<br /> provisioa of any indenture, agreement, morigage, mortgage note or vther instrument to which the
<br /> Owner Is a parry or by which it or its properry is bound and (iu) will not result in the creation or
<br /> imposition of any prohibited lien� chaurge or encumbrance of any nature.
<br /> (c) The Owner will,at the time of execution and delivecy of this Agrament, have good and
<br /> marketdble title to the premises consdtudng the Project free and clear of any prior lien or encumbrance.
