201303289 <br /> 7 <br /> completion of the rulemaking process, and (2) all current requirements in HUD <br /> handbooks and guides, notices, and mortgagee letters that apply to the Project, and all <br /> future updates, changes and amendments thereto, as they become effective, except <br /> that changes subject to notice and comment rulemaking shall become effective only <br /> upon completion of the rulemaking process, and provided that such future updates, <br /> changes and amendments shall be applicable to the Project only to the extent that they <br /> interpret, clarify and implement terms in this Security Instrument rather than add or <br /> delete provisions from such document. Handbooks, guides, notices, and mortgagee <br /> letters are available on HUD's official website: <br /> (http://www.hud.gov/offices/adm/hudclips/index.cfm, or a successor location to that <br /> site). <br /> (ee) "Property Jurisdiction" is defined in Section 30(a). <br /> (ft) "Regulatory Agreement" means the agreement between the Borrower <br /> and HUD establishing Borrower's obligations in the operation of the Mortgaged Property <br /> and the rights and powers of HUD. <br /> (gg) "Remedial Work" is defined in Section 48(i). <br /> (hh) "Rents" means all rents (whether from residential or non-residential <br /> space), revenues, issues, profits, (including carrying charges, maintenance fees, and <br /> other cooperative revenues, and fees received from leasing space on the Mortgaged <br /> Property), and other income of the Land or the Improvements, gross receipts, <br /> receivables, parking fees, laundry and vending machine income and fees and charges <br /> for food and other services provided at the Mortgaged Property, whether now due, past <br /> due, or to become due, Residual Receipts, and escrow accounts, however and <br /> whenever funded and wherever held. <br /> (ii) "Taxes" means all taxes, assessments, vault rentals and other charges, if <br /> any, general, special or otherwise, including all assessments for schools, public <br /> betterments and general or local improvements, which are levied, assessed or imposed <br /> by any public authority or quasi-public authority, and which, if not paid, could become a <br /> lien on the Land or the Improvements. <br /> (jj) "Waste" means a failure to keep the Mortgaged Property in decent, safe <br /> and sanitary condition and in good repair. During any period in which HUD insures this <br /> Loan or holds a security interest on the Mortgaged Property, Waste is committed when, <br /> without Lender's and HUD's express written consent, Borrower: <br /> (1) physically changes the Mortgaged Property, whether negligently or <br /> intentionally, in a manner that reduces its value; <br />
