NPPD <br />J PO Box 499 <br />Columbus, NE <br />• ' 68602 -0499 <br />L22 <br />Underground Fiber Optic <br />RIGHT -OF -WAY EASEMENT <br />That S A V agc S :\) ( •VOA , Try A \ W DJ() ` rOS <br />Grantor(s), of \ County, Nebraska, in consideration of $ 1,92 00 <br />\ , <br />receipt of which is hereby acknowledged, and in consideration of the benefits to accrue to the' <br />easement hereinafter described from the installation of facilities to provide underground fiber <br />optic service, the covenants, conditions and agreements herein contained, does hereby grant <br />and convey unto Nebraska Public Power District (hereinafter the District), its lessees, <br />successors and assigns, the permanent right, privilege, and right -of -way easement to enter upon <br />and to survey, construct, operate, maintain, inspect, repair, remove, alter, relocate and <br />reconstruct its underground fiber optic facilities including all related equipment over, under, upon <br />and across: <br />AN EASEMENT FOR RIGHT -OF -WAY LOCATED IN A PORTION OF THE <br />NORTHEAST QUARTER OF THE SOUTHEAST QUARTER AND A PORTION <br />OF THE EAST HALF OF THE NORTHEAST QUARTER OF SECTION 5, <br />TOWNSHIP 10 NORTH, RANGE 9 WEST OF THE 6 P.M., HALL COUNTY, <br />NEBRASKA. SAID RIGHT -OF -WAY IS A TRACT OF LAND 10 FEET WIDE, <br />BEING 5 FEET ON EACH SIDE OF A REFERENCE LINE, (THE REFERENCE <br />LINE BEING THE APPROXIMATE CENTERLINE LOCATION OF THE <br />UNDERGROUND FIBER OPTIC FACILITIES), SAID REFERENCE LINE IS <br />DESCRIBED AS FOLLOWS: BEGINNING AT A LOCATION ON THE SOUTH <br />LINE 69 FEET WEST OF THE SOUTHEAST CORNER OF THE NORTHEAST <br />QUARTER OF THE SOUTHEAST QUARTER OF SAID SECTION 5; THENCE <br />NORTH, PARALLEL WITH THE EAST LINE OF SAID NORTHEAST QUARTER <br />OF THE SOUTHEAST QUARTER, TO THE NORTH LINE OF SAID <br />NORTHEAST QUARTER OF THE SOUTHEAST QUARTER; THENCE <br />CONTINUING NORTH, PARALLEL WITH AND 69 FEET WEST OF THE EAST <br />LINE OF SAID EAST HALF OF THE NORTHEAST QUARTER, TO THE <br />TERMINATION OF SAID REFERENCE LINE ON THE NORTH LINE OF SAID <br />EAST HALF OF THE NORTHEAST QUARTER. THE RIGHT -OF -WAY FOR THE <br />UNDERGROUND FIBER OPTIC FACILITIES CONTAINS 0.91 ACRE(S), MORE <br />OR LESS OF WHICH THE NORTH 33 FEET THEREOF IS LOCATED WITHIN <br />PUBLIC RIGHT -OF -WAY FOR SCHIMMER DRIVE. <br />The actual location of the underground fiber optic facilities may deviate within said easement <br />area. <br />The District shall have the right to ingress and egress across and along the property within the <br />easement area for any purpose in connection with its survey, construction, operation, <br />maintenance, inspection, repair, removal, alteration, relocation and reconstruction of said <br />underground fiber optic facilities and related equipment. <br />The District shall have the right at any time to trim or remove such trees and underbrush as may <br />in any way endanger or interfere with the safe construction, operation, maintenance, alteration or <br />reconstruction of its underground fiber optic facilities and equipment used in connection <br />therewith. <br />No buildings, structures, improvements or trees shall be located so as to interfere with said <br />easement except by express written permission from the District.
