RESERVATIONS AND CONDITIONS 201302452 LINE; THENCE SOUTHERLY DEFLECTING 090 DEGREES, 45 MINUTES, 15 SECONDS RIGHT, A DISTANCE OF 1143.42 FEET ALONG SAID RIGHT OF WAY LINE TO A POINT ON THE NORTHERLY SCHULTZ ROAD RIGHT OF WAY LINE; THENCE SOUTHERLY DEFLECTING 000 DEGREES, 51 MINUTES, 08 SECONDS LEFT, A DISTANCE OF 55.00 FEET TO A POINT ON THE SOUTH LINE OF SAID QUARTER SECTION; THENCE WESTERLY DEFLECTING 089 DEGREES, 59 MINUTES, 38 SECONDS RIGHT, A DISTANCE OF 33.00 FEET ALONG THE SOUTH LINE OF SAID QUARTER SECTION TO THE POINT OF BEGINNING CONTAINING 1.26 ACRES, MORE OR LESS. (AS SHOWN ON ATTACHED EXHIBIT "A ") The County of Hall, Nebraska shall be solely responsible for the maintenance of the above described roadway and shall hold the State of Nebraska harmless from all claims or actions for damages to persons or property arising out of the use, maintenance or operations of said roadway. The County of Hall, Nebraska shall prohibit the use of the above described roadway for the storage, processing, sorting, transfer or any other use related to or connected with scrap material of any nature or kind; or any use that create an unsightly or obnoxious appearance upon said roadway The County of Hall, Nebraska shall prohibit the erection or display of any advertising sign, device or display, whatsoever, on the roadway described above. All rights, title or interest relinquished by this instrument to the County of Hall, Nebraska shall revert to the State of Nebraska, Department of Roads, if the roadway described above ceases to be used and maintained by the County of Hall, Nebraska as a public road. In accordance with Article III, Section 20 of the Constitution of the State of Nebraska, the State of Nebraska, Department of Roads, dose hereby retain and reserve to itself all salt, springs, coal, oil, gas, natural resources or other mineral rights it may have in or on the above described real property. The State of Nebraska, Department of Roads, reserves an easement for the operation, maintenance and use of any and all existing utilities which are located over, under or upon the above described roadway. This instrument is certified as being executed according to law and that it is a matter of public record in the custody of the Department of Roads, Lincoln, Nebraska.
