<br />the Southeast Quarter of said Section 20, TOGETHER WITH the east 33.00 feet of the south
<br />1400.00 feet of the Southeast Quarter of said Section 20, containing 1.42 acres, more or less,
<br />Parcel Two: A tract of land being part of the Southwest Quarter of the Southwest Quarter
<br />(SW 1/4 SW 1/4) of Section Twenty -One (21), Township Ten (10) North, Range Nine (9) West of
<br />the Sixth Principal Meridian, Hall County, Nebraska, more particularly described as the west
<br />33.00 feet of the Southwest Quarter of the Southwest Quarter of said Section 21, containing 1.00
<br />acre, more or less
<br />(hereinafter collectively referred to as the "Ellis Condemned Property "); and
<br />WHEREAS, on or about January 5, 2011, the County filed a condemnation action against
<br />Little E and the Ellises in the County Court of Hall County, Nebraska, captioned County of Hall,
<br />Nebraska, Condemnor, v. Little E Eagle, Inc., a Nebraska corporation, Addren D. "John" Ellis,
<br />Patsy A. Ellis, Russell Ellis, Cindy Ellis and All Persons Having or Claiming Any Interest in the
<br />Real Estate, Real Names Unknown, Condemnees, and docketed therein as Case No. CI11 -49 (the
<br />"Little E Condemnation Action "), in which the County sought to condemn and acquire by
<br />exercise of the power of eminent domain approximately 0.03 acres located within the Little E
<br />Property, said 0.03 acres being legally described as follows:
<br />A tract of land being part of Government Lot Two (2) of Section Twenty -eight (28),
<br />Township Ten (10) North, Range Nine (9) West of the Sixth Principal Meridian, Hall County,
<br />Nebraska, more particularly described as the north 33.00 feet of the west 33.00 of Government
<br />Lot Two (2) of said Section 28, containing 0.03 acres.
<br />(hereinafter referred to as the "Little E Condemned Property"); and
<br />WHEREAS, the County's purpose for the condemnation of the Ellis Condemned
<br />Property and the Little E Condemned Property was to construct a public road on said property to
<br />provide vehicular ingress and egress to the Kroeger Property and the County Property; and
<br />WHEREAS, on or about January 14, 2011, the appraisers appointed by the County Judge
<br />of Hall County, Nebraska, in the Ellis Condemnation Action assessed and allowed damages for
<br />the Ellis Condemned Property in the total amount of $39,200.00 as set forth in the Return of
<br />Appraisers filed January 14, 2011; and
<br />WHEREAS, on or about September 9, 2011, the appraisers appointed by the County
<br />Judge of Hall County, Nebraska, in the Little E Condemnation Action assessed and allowed
<br />damages for the Little E Condemned Property in the total amount of $780.00 as set forth in the
<br />Return of Appraisers filed September 9, 2011; and
<br />WHEREAS, the County deposited in the County Court of Hall County, Nebraska, the
<br />above - referenced damage awards for the Ellis Condemned Property and the Little E Condemned
<br />Property as required by statute; and
