2 01302392 <br />$918,274.70 French Village <br />Santee, California [location of execution) Grand Island, Hall County, NE <br />March , 2013 Original FHA Project No. 103 -11017 <br />RIDER TO MULTIFAMILY DEED OF TRUST, <br />ASSIGNMENT OF LEASES AND RENTS <br />AND SECURITY AGREEMENT <br />(HUD- 94000M) <br />MORTGAGE RESTRUCTURING DEED OF TRUST <br />THIS RIDER ( "Rider ") is attached to and made a part of that certain MULTIFAMILY <br />DEED OF TRUST, ASSIGNMENT OF LEASES AND RENTS AND SECURITY <br />AGREEMENT dated March 4 21" L ' , 2013 (the "Security Instrument "), made by CARMALOR <br />NEBRASKA L.P., a Nebraska limited partnership (the "Borrower "), for the benefit of <br />SECRETARY OF HOUSING AND URBAN DEVELOPMENT (hereafter referred to as the <br />"Secretary" or "Lender "). <br />RECITALS: <br />A. Secretary is making a loan (referred to herein as either the "MAHRA Restructuring <br />Loan" or "Mortgage Restructuring Loan ") to the Borrower pursuant to the Multifamily Assisted <br />Housing Reform and Affordability Act of 1997, Title V of the Departments of Veterans Affairs, <br />Housing and Urban Development and Independent Agencies Appropriations Act, 1998 (Pub. L. No. <br />105 -65, 111 Stat. 1384, approved on 10/27/97), as amended ( "MAHRA "), and/or the Regulations <br />adopted by the Secretary pursuant thereto ( "MAHRA Regulations "), as part of a rent and debt <br />restructuring (the "Restructuring') in accordance with a Restructuring Commitment (the <br />"Restructuring Commitment ") between the Borrower and Secretary, which is incorporated herein <br />and made a part hereof. <br />B. This Rider amends certain terms and conditions of the Security Instrument, so that <br />the Security Instrument, as amended (the "Mortgage Restructuring Mortgage "), includes provisions <br />applicable to MAHRA and the MAHRA Regulations, and secures the Mortgage Restructuring Loan. <br />The Mortgage Restructuring Loan is evidenced by, inter alia, the Note, which is defined therein as <br />the "Mortgage Restructuring Note ". <br />NOW THEREFORE, for and in consideration of the MAHRA Restructuring Loan and other <br />good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the <br />parties hereto agree as follows: <br />1.
