(14) all forfeited tenant security deposits under any Lease; <br />201302390 <br />(15) all names under or by which any of the above Mortgaged Property may be <br />operated or known, and all trademarks, trade names, and goodwill relating to any of the <br />Mortgaged Property; <br />(16) all deposits and /or escrows held by or on behalf of Lender under Collateral <br />Agreements; and <br />(17) all awards, payments, settlements or other compensation resulting from litigation <br />involving the Project. <br />s. "Non Profit Borrower" means a Borrower that is treated under the Firm <br />Commitment issued by HUD to Lender as a corporation or association organized for <br />purposes other than profit or gain for itself or persons identified therewith, pursuant to <br />501(c)(3) or other applicable provisions of the Internal Revenue Code. The entity may <br />not make Distributions to any individual member or shareholder. The definition of "Non - <br />Profit Borrower" does not include a non - profit borrower who is treated under the Firm <br />Commitment as a for profit borrower. <br />t. "Note" means the Note executed by Borrower described in the Security Instrument, <br />including all schedules, riders, allonges and addenda, as such Note may be amended <br />from time to time. <br />u. "Notice" is defined in Section 46. <br />v. "Personalty" means all equipment, inventory, and general intangibles.
