I. "Improvements" means the buildings, structures, and alterations now constructed <br />or at any time in the future constructed or placed upon the Land, including any future <br />replacements and additions. <br />m. "Indebtedness" means the principal, interest on, and all other amounts due at any <br />time under the Note or the Security Instrument, including prepayment premiums, late <br />charges, default interest, and advances to protect the security as provided in the <br />Security Instrument. <br />n. "Land" means the estate in realty described in Exhibit A. <br />201302390 <br />4 <br />o. "Leases" means all present and future leases, subleases, licenses, concessions or <br />grants or other possessory interests now or hereafter in force, whether oral or written, <br />covering or affecting the Mortgaged Property, or any portion of the Mortgaged Property <br />(including but not limited to proprietary leases, non - residential leases or occupancy <br />agreements if Borrower is a cooperative housing corporation), and all modifications, <br />extensions or renewals. (Ground leases that create a leasehold interest in the Land and <br />where the Borrower's leasehold is security for the Loan are not included in this <br />definition.) <br />p. "Lender" means the entity identified as "Lender" in the first paragraph of the <br />Security Instrument, or any subsequent holder of the Note, and whenever the term <br />"Lender" is used herein, the same shall be deemed to include the Obligee, or the <br />Trustee(s) and the Beneficiary of the Security Instrument and shall also be deemed to <br />be the Mortgagee as defined by Program Obligations. <br />q. "Limited Dividend Borrower" means a limited dividend /distribution corporation or <br />other limited dividend /distribution entity that is restricted as to rate of return and other <br />aspects of its operation. <br />r.
