48. ENVIRONMENTAL HAZARDS. <br />(a) Definitions: <br />Previous editions are obsolete <br />201302389 <br />41 <br />protect such Improvements from depredation or injury and to preserve and protect the <br />Personalty therein, to continue any and all outstanding contracts for the erection and <br />completion of said Improvements, to make and enter into any contracts and obligations <br />wherever necessary, either in its own name or in the name of Borrower, or other owner, <br />and to pay and discharge all debts, obligations, and liabilities incurred thereby. All such <br />sums so advanced by Lender (exclusive of advances of the principal of the <br />Indebtedness) shall be added to the principal of the Indebtedness secured hereby and <br />all shall be secured by this Security Instrument and shall be due and payable on <br />demand with interest at the rate provided in the Note, but no such advances shall be <br />insured unless same are specifically approved by HUD prior to the making thereof. The <br />Indebtedness shall, at the option of Lender or holder of this Security Instrument and the <br />Note, become due and payable on the failure of Borrower, or other owner, to keep and <br />perform any of the covenants, conditions and agreements of the Building Loan <br />Agreement. This covenant shall be terminated upon the completion of the <br />Improvements to the satisfaction of Lender and the making of the final advance as <br />provided in the Building Loan Agreement. <br />(1) "Hazardous Materials" means petroleum and petroleum products <br />and compounds containing them, including gasoline, diesel fuel and <br />oil; explosives; flammable materials; radioactive materials; <br />polychlorinated biphenyls ( "PCBs ") and compounds containing <br />them; lead and lead -based paint; asbestos or asbestos - containing <br />materials in any form that is or could become friable; underground <br />or above - ground storage tanks, whether empty or containing any <br />substance; any substance the presence of which on the Mortgaged <br />Property is prohibited by any Governmental Authority; any <br />substance that requires special handling; and any other material or <br />substance now or in the future defined as a "hazardous substance," <br />"hazardous material," "hazardous waste," "toxic substance," toxic <br />pollutant," "contaminant," or "pollutant" within the meaning of any <br />Hazardous Materials Law. <br />(2) "Hazardous Materials Laws" means all federal, state, and local <br />laws, ordinances and regulations and standards, rules, policies and <br />other governmental requirements, administrative rulings and court <br />judgments and decrees in effect now or in the future and including <br />all amendments that relate to Hazardous Materials and apply to <br />HUD MF Security Instrument HUD- 94000M (Rev.11 /12) <br />
