201302 <br />34. SUCCESSORS AND ASSIGNS BOUND. This Security Instrument shall <br />bind, and the rights granted by this Security Instrument shall inure to, the respective <br />successors and assigns of Lender and Borrower. <br />35. JOINT AND SEVERAL LIABILITY. If more than one person or entity <br />signs this Security Instrument as Borrower, the obligations of such persons and entities <br />shall be joint and several. <br />36. RELATIONSHIP OF PARTIES; NO THIRD PARTY BENEFICIARY. <br />Previous editions are obsolete <br />37 <br />Mortgaged Property in segregated accounts and (b) Borrower (1) shall not acquire <br />any real or personal property other than the Mortgaged Property and personal property <br />related to the operation and maintenance of the Mortgaged Property, and so long as the <br />Loan is insured or held by HUD, except pursuant to the Regulatory Agreement and <br />Program Obligations and (2) shall not own or operate any business other than the <br />management and operation of the Mortgaged Property, and so long as the Loan is <br />insured or held by HUD, except pursuant to the Regulatory Agreement and Program <br />Obligations. <br />(a) The relationship between Lender and Borrower shall be solely that of <br />creditor and debtor, respectively, and nothing contained in this Security Instrument shall <br />create any other relationship between Lender and Borrower. <br />(b) No creditor of any party to this Security Instrument and no other person <br />(the term "person" includes, but is not limited to, any commercial or governmental entity <br />or institution) shall be a third party beneficiary of this Security Instrument, the Note, or <br />so long as the Loan is insured or held by HUD , the Regulatory Agreement. Without <br />limiting the generality of the preceding sentence, (1) any servicing arrangement <br />between Lender and any loan servicer for loss sharing or interim advancement of funds <br />shall constitute a contractual obligation of such loan servicer that is independent of the <br />obligation of Borrower for the payment of the Indebtedness, (2) Borrower shall not be a <br />third party beneficiary of any servicing arrangement, and (3) no payment by the loan <br />servicer under any servicing arrangement shall reduce the amount of the Indebtedness. <br />HUD MF Security Instrument HUD- 94000M (Rev.11/12) <br />
