UNDERGROUND WATER LINE EASEMENT <br />201302366 <br />This agreement dated this / g' day of March, 2013 by and between Ruth Gibbs <br />(hereinafter "Gibbs") and Quattro Farms, LLC (hereinafter "Quattro "). <br />WITNES SETH: <br />1. Gibbs is the owner of the following described property situated in Hall County, Nebraska, <br />to wit: - <br />Lot One (1), Rauert Second Subdivision, Hall County, Nebraska. <br />2. . Quattro is the owner of the following described real estate situated in Hall County, <br />Nebraska: <br />The N1 /2NW1 /4 and the N1 /2SW1 /4NW14 of Section 17, in Township 12 <br />North, Range 9 West of the 6 P.M., Hall County, Nebraska, EXCEPT those <br />tracts of land described in Survivorship Warranty Deeds recorded as Document <br />#78- 002889 and Document #79- 006574 in the Register of Deed Office, Hall <br />County, Nebraska, AND EXCEPT Lot 1, Rauert Second Subdivision, Hall <br />County, Nebraska. <br />3. Quattro irrigates the property owned by it, but there is an underground water line to <br />Quattro's property which passes under property owned by Gibbs, generally described as <br />follows: <br />The Westerly 10 feet of the entire west boundary Lot One (1), Rauert Second <br />Subdivision; Hall County, Nebraska. <br />4. By these presents, Gibbs grants to Quattro, its successors and assigns, the right to enter <br />upon the property owned by Gibbs described above for the purposes of repair and <br />maintenance of the underground water line.. Quattro agrees to always restore the property <br />to the condition that existed prior to its entry onto the land for purposes of making <br />necessary repairs, at Quattro's sole expense, and Quattro shall indemnify Gibbs or her <br />successors from liability whatsoever form. Quattro shall give at least three (3) days prior <br />noticer to Gibbs of the date /time when Quattro, its agents or assigns, will enter upon the <br />Gibbs' property. <br />- 5. The parties acknowledge that at a future time, a more definite legal description shall be <br />prepared, which defines with precision the area covered by the easement granted by Gibbs <br />to Quattro herein. <br />It is agreed by Gibbs and. Quattro that the right of entry for purposes of repairs and <br />maintenance shall consist of the land directly above the water line and 10 feet to the east <br />thereof and 10 feet to the west thereof. <br />lfrgsq <br />
