TO HAVE AND TO HOLD the above - described premises, together with all the tenements, hereditaments, and appurtenances thereunto belonging, unto the said Grantee and to Grantee's successors and assigns forever. Grantors hereby covenant with the said Grantee and with Grantee's successors and assigns that Grantors are lawfully seised of such premises; that such premises are free from encumbrance, except real estate taxes and sums owing to Grantee; and that Grantors have good right and lawful authority to sell the same; and Grantors hereby covenant to warrant and defend the title to said premises against the lawful claims of all persons whomsoever. Grantors hereby relinquish all right, title, claim, and interest in and to the above - described premises. This Special Warranty Deed is given as an absolute conveyance, the Grantors having conveyed said land to the Grantee for fair and adequate consideration, such consideration being satisfaction of obligations evidenced by that certain Note dated August 9, 2007, and secured by a Deed of Trust filed of record in the office of the Register of Deeds of Hall County, Nebraska, on August 13, 2007, as Instrument No. 200706906.
