The Trustor is VERNON D. <br />ROBBINS and KAY L. ROBBINS, husband and wife, a /k/a Borrower. The Trustee is <br />Bruce L. Hart, a member of the Nebraska State Bar Association. The Beneficiary is Kay <br />L. Robbins, TOD or transferred on death to TRUST B of THE KAY ROBBINS TRUST, <br />under Revocable Trust Agreement, dated November 11, 2006, as amended, a /k/a <br />Lender. Beneficiary's address is Kay Robbins, 404 Wyandotte Street, Grand Island, NE <br />68801. Borrower irrevocably conveys to Trustee, in Trust, with power of sale, the <br />following: <br />The Easterly Twenty Feet (20') of Lot Fifteen (15) and all of Lot Sixteen <br />(16), in Block Three (3), Second Addition to Holcomb's Highway Homes <br />Subdivision, in the City of Grand Island, Hall County, Nebraska, <br />together with all the rents and profits therefrom and subject to easements and <br />restrictions of record, if any. <br />Borrower owes Lender $111,228.19, evidenced by Borrower's note of even date, <br />payable according to the terms thereof. <br />This security instrument secures to Lender the debt evidenced by said note, the <br />payment of all other sums, with interest, advanced under the provisions hereafter to <br />protect the security and the performance of Borrower's covenants and agreements. <br />Borrower covenants that Borrower is lawfully seized of such real estate and has the <br />legal power and lawful authority to convey the same and warrants and will defend title to <br />the real estate against the lawful claims of all persons. <br />BORROWER AND LENDER AGREE AS FOLLOWS: <br />Hart & Sudbeck, P.C., L.L.O. <br />Cozad, Nebraska <br />-2- <br />201301 <br />A. Borrower shall pay when due, the principal and interest as provided in said <br />note. <br />B. All payments received by Lender shall be first applied to advances, which <br />may have been made by Lender and then to interest due and last to <br />principal due. <br />C. Borrower shall pay all general real estate taxes and special assessments <br />against the property before the same become delinquent. <br />D. Trustor shall keep the Property in good condition and repair and shall not <br />commit waste or permit impairment or deterioration of the Property and <br />shall comply with the provisions of any lease if this Deed of Trust is on a <br />leasehold. No improvement now or hereafter erected upon the Property <br />shall be altered, removed or demolished without the prior written consent of <br />Beneficiary.
