Dixson and Lesa M. Dixson, Husband and Wife, hereinafter referred to as <br />"Grantors ", own the North Half of the Northeast Quarter lying east of U.S. Highway Number 34 <br />Right -of -Way located in Section 36, Township 11 North, Range 9 West, of the 6 P.M., Hall <br />County, Nebraska, as described in Instrument No. 0200316195 and recorded in the Hall County <br />Register of Deeds Office, Grand Island, Nebraska, and <br />That, Nebraska Public Power District, hereinafter referred to as "District ", is a public corporation <br />and political subdivision of the State of Nebraska, and <br />That, District has previously obtained an easement to survey, ,construct, operate,- 'maintain, <br />inspect, repair, remove, alter, relocate and reconstruct an electric transmission line known as <br />the Grand Island to Riverdale 230kV transmission line, which is described in Miscellaneous <br />Book 20, on Page 164, and recorded in the Hall County Register ofDee &s Office, Grand Island, <br />Nebraska on February 5 1970. <br />That, District desires to obtain additional access to the above - described property by obtaining <br />an Agreement for Off Right -of -Way Access (Agreement) to a portion of its electric transmission <br />line located on the real property described above. <br />NOW, THEREFORE, in consideration of '5' 1, v 0 , receipt of which is <br />hereby acknowledged, Grantors hereby grant to District, its lessees, successors and assigns, <br />the perpetual right and privilege to use an off right -of -way access across a portion of the above <br />lands in the North Half of the Northeast Quarter lying east of U.S. Highway Number 34 Right -of- <br />Way located in Section 36, Township 11 North, Range 9 West, of the 6 P.M., Hall County, <br />Nebraska. <br />The off right -of -way access shall be used by the District to gain access for ingress and egress to <br />its electric transmission line in order to survey, construct, operate, maintain, inspect, repair, <br />remove, alter, relocate and reconstruct said electric transmission line as authorized under the <br />terms and conditions of the above - described easement, which has been recorded in the public <br />records in Hall County, Nebraska. The District understands and agrees that Grantors shall be <br />able to continue occupancy and use of all of Grantor's property, including, but not limited to, the <br />off right -of -way access area described herein. <br />The access route to be used by District shall be a route as direct as possible to the District's <br />transmission line structures located in the North Half of the Northeast Quarter lying east of U.S. <br />Highway Number 34 Right -of -Way located in said Section 36 and shall be a maximum of 20 feet <br />in width. Said route shall be as marked on the attached map which is made a part of this <br />Agreement as Exhibit "A ". Upon the mutual agreement of Grantors and the District, said route <br />may be changed whenever it becomes impassable or when it is in the best interest of good <br />husbandry and conservation of the lands crossed to change the route. <br />District agrees to pay Grantors or Lessee, as their interest may appear, for any damages to <br />personal property, fences, livestock and growing crops resulting from the District's use of the <br />access route. <br />L22 <br />Tract # 08-01- 023030 Page 1 of 3 <br />r <br />�-1 <br />Q <br />0 <br />
