<br />THIS DEED OF TRUST is made as of the day of C:(l'lL2&V L , 2013, by
<br />J.J.A. HOLDINGS, L.L.C., By Its Members, Darlo Beazley and Patricia Beazle , husband and
<br />wife, ( "TRUSTOR "), whose mailing address is 1810 Highway 58, Dannebrog, Nebraska
<br />68831and Jamie Mues Jankovitz, Attorney at Law, ( "TRUSTEE "), whose mailing address is:
<br />202 W. 3rd St., P.O. Box 639, Grand Island, Nebraska 68802 -0639 and Joy M. Beazley and
<br />Marietta Beazley, husband and wife, ( "BENEFICIARY ") whether one or more, whose mailing
<br />address is #16 St. James Place, Grand Island, NE 68803.
<br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys, and
<br />assigns to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of
<br />Beneficiary, under and subject to the terms and conditions of this Deed of Trust, the real
<br />property located in Hall County, Nebraska, and legally described as follows:
<br />(the "Property"):
<br />Lot Five (5), in Block Eighteen (18), in Arnold and Abbott's Addition to the City of
<br />Grand Island, Hall County, Nebraska, except that portion deeded to the State of Nebraska
<br />in deed filed August 16, 2006 as Instrument No. 200607311;
<br />and
<br />Lots Six (6), Seven (7), and Eight (8), in Block Eighteen (18), in Arnold and Abbott's
<br />Addition to the City of Grand Island, Hall County, Nebraska, except that portion deeded
<br />to the State of Nebraska, Department of Roads in deed filed November 3, 2006, as
<br />Instrument No. 200609874
<br />TOGETHER WITH all rents, easements, appurtenances, hereditaments, interests in
<br />adjoining roads situated thereon.
<br />The property and the entire estate and interest conveyed to the Trustee are referred to
<br />collectively as the "Trust Estate ".
<br />a. Payment of indebtedness of the total principal amount of $100,000.00 with
<br />interest thereon at the rate of 3.00 % per annum, as evidenced by a Promissory Note of even date
<br />(the "Note ") with a maturity date of January 1, 2018, executed by Trustor, which has been
<br />delivered and is payable to the order of Beneficiary, and which by this reference is hereby made
<br />a part hereof, and any and all modifications, extensions and renewals thereof.
<br />b. Payment of all sums advanced by Beneficiary to protect the Trust Estate, with interest
<br />thereon at the rate of 3.00 % percent per annum, the default rate.
<br />This Deed of Trust, the Note, and any other instrument given to evidence or further
<br />secure the payment and performance of any obligation secured hereby are referred to collectively
<br />as the "Loan Instruments ".
