M i <br /> f 6-I ret <br /> ip....... <br /> , z __ , <br /> z> _ ., <br /> 1 <br /> m co <br /> 00 <br /> cs) \ --t, , <br /> ° CIS CID <br /> A <br /> 1 <br /> Y AMENDMENT TO DECLARATION <br /> The following signers, consisting of more than one-half(1/2) of the Units, hereby amend the 3L)OD <br /> Declaration filed at- -097483-of the Records of Hall County,Nebraska as to the following described real <br /> property,to-wit: 77"cv07304 <br /> That part of Riverside Estates Unit 1, a subdivision as surveyed, platted and recorded in <br /> part of the SW '/4 of Section 28, Township 14 North,Range 9 West of the 6th P.M., Hall <br /> County, Nebraska, lying South of the South R.O.W line of Stagecoach Road and lying <br /> East of the West lot line of Lot 46, extended Southward to the South line of said <br /> Riverside Estates Unit 1. <br /> • ARTICLE VIII INSURANCE shall be replaced with the following: <br /> ARTICLE VIII <br /> INSURANCE <br /> Section 1. Basic Coverage. <br /> The Association shall obtain and maintain,to the extent obtainable: <br /> (a.) Fire and extended coverage. The Association shall maintain a blanket, "all-risk" form <br /> policy of fire insurance with extended coverage, vandalism, malicious mischief, <br /> windstorm, sprinkler leakage (if available), debris removal, cost of demolition and water <br /> damage endorsements, insuring the property and improvements. Coverage shall include <br /> floor coverings, wall coverings, bathroom and kitchen fixtures, lighting fixtures, <br /> cabinetry, the entire fmish of basements, all air-conditioning and heating equipment and <br /> other service machinery, and appliances installed in the units and any improvements <br /> made to the property. The policy shall cover the interests of the Association and all unit <br /> owners and their mortgagees, as their interests may appear, subject to loss payment and <br /> adjustment provision in favor of the Association. Coverage shall be in an amount equal <br /> to one hundred percent (100%) of the then current replacement cost of the property, <br /> without deduction for depreciation, the amount to be determined annually by the Board, <br /> with assistance of the insurance company affording coverage. <br /> (b.) Liability Insurance. The Association shall maintain liability insurance, including medical <br /> payments insurance, in an amount determined by the Board,but not less than One Million <br /> Dollars ($1,000,000.00), covering all occurrences commonly insured against for death, <br /> bodily injury, and property damage arising out of or in connection with the use, <br /> ownership or maintenance of the common elements or common area. The Board may <br /> determine that additional coverage may be necessary and may obtain additional coverage <br /> if it is deemed necessary. <br /> (c.) If the aforementioned insurance is not reasonably available, the Association shall cause <br /> notice of that fact to be hand delivered or sent prepaid by United States Mail to all unit <br /> owners. <br /> IISection 2.Provisions. <br /> Insurance policies must provide that: <br /> (a) Each unit owner is an insured person under the policy with respect to liability arising out <br /> of his or her interest in the common elements or membership in the Association; <br />
