Connick, being first duly sworn, deposes and states as follows: <br />1. Affiant is the attorney who drafted that certain Declaration of Restrictive <br />Covenants, Restrictions and Conditions for Sterling Estates Homeowners Associated dated <br />March 4, 2011, which is filed in the Office of the Hall County, Nebraska Register of Deeds on <br />April 19, 2011 as Instrument No. 201102972 ( "Restrictive Covenants ") and is indexed against <br />the following described real estate (collectively, the "Subject Property "): <br />Block Three (3), Lots One (1) through Eight (8), Sterling Estates Subdivision, in the City <br />of Grand Island, Hall County, Nebraska; <br />Block Seven (7), Lots One (1) through Eight (8), Sterling Estates Subdivision, in the City <br />of Grand Island, Hall County, Nebraska; and <br />Block Eight (8), Lots One (1) through Six (6), Sterling Estates Subdivision, in the City of <br />Grand Island, Hall County, Nebraska. <br />2. Due to scrivener's error, the legal description of the Subject Property as contained <br />in Article I., Article IL, Article III., Section B, Paragraph 18, and Article V., Paragraph 7, of the <br />Restrictive Covenants failed to identify that the Subject Property is part of the Sterling Estates <br />Subdivision, in the City of Grand Island, Hall County, Nebraska. <br />3.
