<br />In accordance with the provisions of the Nebraska Farm Homestead Protection Act, Neb.
<br />Rev. Stat. Sections 76- 1901, et seq., as a preface to the execution, and as a part of the following
<br />Deed of Trust, the undersigned Trustor being first duly sworn, elect to Disclaim the Right to
<br />Designate a Homestead.
<br />We disclaim the right to designate a homestead on the property described in the following
<br />Deed of Trust. No part of our homestead is presently, or in the future will be, situated upon said
<br />real estate. We understand that if we establish a homestead on any part of the real estate during
<br />the time the Deed of Trust remains unsatisfied and a lien on the real estate, we shall have no right
<br />to make a designation of homestead in the event of a Trustee's sale or a foreclosure sale.
<br />THIS DEED OF TRUST is made as of this 27 day of December 2012, by and among
<br />JEREMY L. GEWECKE and ASHLEY N. GEWECKE, husband and wife, ( "TRUSTOR ")
<br />whether one or more, whose mailing address is 8584 W. US Highway 30, Wood River, NE
<br />68883;
<br />and DUANE A. BURNS, a member of the Nebraska State Bar Association ( "TRUSTEE "),
<br />whose mailing address is P.O. Box 2300, Grand Island, Nebraska 68802;
<br />and RICHARD W. WEBSTER and MARILYN D. WEBSTER, husband and wife, as joint
<br />tenants, ( "BENEFICIARIES "), whose mailing address is 3307 Schroeder Avenue, Grand
<br />Island, Nebraska 68803.
<br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys, and
<br />assigns to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of
<br />Beneficiaries, under and subject to the terms and conditions of this Deed of Trust, the real
<br />property located in the County of Hall, State of Nebraska, and legally described as follows:
<br />(the "Property "):
<br />The Northwest Quarter (NW%) and the West Half of the Northeast Quarter
<br />(W'ANE %) of Section Twelve (12), Township Ten (10) North, Range Eleven
<br />(11) West of the 6 P.M., Hall County, Nebraska, lying North of the Union
<br />Pacific Railroad Company Right of Way EXCEPT a certain tract more
<br />particularly described in Warranty Deed recorded as Document No.
<br />200705080 and EXCEPT a certain tract more particularly described in
<br />Corrective Warranty Deed recorded as Document No. 200706720 and
<br />EXCEPT Lot One (1), RMW Subdivision, Hall County, Nebraska.
