<br /> This instx•ument, made this 22°d day of July, 2011, between Eric H. Lindquist, a member of
<br /> the Nebraska State Bar Association, Successor T'rustee, hereinafter called "Grantor", pursuant to a
<br /> power of sale contained in that certain Deed of Trust recorded on July 16, 2007 as Instrument No.
<br /> 0200706013 in the office of the Register of Deeds of Hall County, Nebraska, and the Secretary of
<br /> the Department of Housing and Urban Development,hereinafter cailed"Grantee".
<br /> WHEREAS, on May 5, 2011, Grantor, executed a Notice of Dcfault pursuant to which
<br /> noticc was given to Allen D. Vargason, a single man, Trustor, under that certain l7eed of Trust
<br /> recorded on July 16, 2007 as Instrument No. 0200706013 in the office of the Register of lleeds of
<br /> Hall County,Nebraska, covering that certain premises described as:
<br /> LOTS NINE AND TEN, BLOCK TIIREE, CLARKSON'S PIRST ADDITION
<br /> 1'O"1'HE VILLAGE OF ALDA, HALL COUNTY,NEBRASKA,
<br /> xhat a breach of an obligation for which thc trust property was conveyed had occurred, and setting
<br /> torth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br /> the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br /> Hall County,Nebraska,on May 6,2011,as In��trument No. 201 103470.
<br /> A copy of such Notice of Default �ras thereafter mailed to all parties entitled to notice
<br /> pursuant to said Deed of Trust and in complia ice with Neb.Rcv. Stat. §76-1008.
<br /> Subsequent thereto, beginning on Ji�ne 9, 2011, Grantor caused to be published in The
<br /> Grand Island Independent, a newspaper ha• ing a general circulation in IIall County, Nebraska, a
<br /> Notice of Trustee's Sale setting forth a des�ription of the property to be sold and stating that the
<br /> described property would be sold at publi�� auction to the highest bidder for cash or certified or
<br /> cashier's check, at the lower level lobby of .he Hall County Courthouse, 1 st 8z Locust Street, Grand
<br /> lsland, Hall County,Nebraska at 2:00 p.in. on July 21, 201 1. Publication of such notice was madc
<br /> lor five consecutive weeks on Junc 9,201 1,June 16, 2011,June 23,201 1,June 30,201 1 and July 7,
<br /> 20]1,the last publication being at least teri(10) days but not mare than thirty (30) days prior to the
<br /> date of salc.
<br /> A copy of such notice of the tir ie and place of sale was thereafter mailcd to all parties
<br /> entitled to notice pursuant to said Deed oi Trust and in compliance with Neb. Rev. Stat. §76-1008.
<br /> Pursuant to said Notice of Tn�stee's Sale, John B. McDermott, attorney for Grantor, did at
<br /> the time and place mentioned in said I`dotice of Trustee's Sale, offer said property for sa]e at public
<br /> auction, and did sell the same to Flagstar Bank, FSB far the sum of$95,537.29, it being the highest
<br /> bidder thcrefor. Flagstar Bank, FSF3 has assigned all of its right, title and intcrest in such bid to
<br /> Grantee.
<br /> NOW, THERF,FORE, in consideration of the premises and of the sum of$95,537.29 so bid
<br /> �3nd paid as aforesaid, I, Grantor, do hereby grant and convey unto said Grantee, its successors and
<br /> assigns forever, all the estate, right, title and interest of which the said Allcn D. Vargason, a single
