<br /> 21. HazardousSubstances.As used in this Section 21: (a) "Hazardoux Substance.c"are those substances
<br /> defined as toxic or hazardous substances,pollutants,or wastes by Environmental Law xnd the following
<br /> substances: gasoline,kerosene,other tlammable or toxic petroleum products,toxic pesticides and herbicides,
<br /> volatile solvents, materials containing asbestos or formaldehyde, and radioactive materials; (b)
<br /> "Environmenlal Law" means fcdeml laws and la�as of the jurisdictio�where the Property is located that
<br /> relate to health, safcty or environmental protcction; (c) "Envlronmen6al Clearzup"includes any response
<br /> actioq remedial actioq or removal action, as defined in Environmental Law; and(d) an "Environmental
<br /> Condilaon"means a condition that can cause, contribute to, or othenvise Uigger an Envuonmental Cleanup.
<br /> Borrower shall not cause or permit the presence,use, disposal,storagc,or release of any Hazardous
<br /> Sabstances,or threaten to xelease any Hazardous Substances,ou or in the Property. Borrower shall not do,
<br /> nor allow anyone else to do,anything aft�ecting the Property(a)that is iu violation of any Environmentai
<br /> Law, (b)whieh creates an Environmental Condition, or(c)�vhich,dua to the p�esence,use, or release of a
<br /> Hazardous Substance,crea[es a condition that adversely affccts the value of the Property.The preceding two
<br /> seutences shall not apply to the presence, use, or storage on the Property of small quantities oY Hazardous
<br /> Substanees that arc generally�ecognized to be appropriate to normal residential uses and fo maintenance of
<br /> the Property(including,but not limited to,hazardous snbstances in consumer products).
<br /> Boaower shall promptly give Lendec written notice of(a)any investigation,claim,demand, lawsuit or othei
<br /> action by any governmental or regulatory agency or private party involving the Property and any Hazazdous
<br /> Substance or Environmental Law of�vhich Bonower has actual knowledge,(b)any Environmen[al
<br /> Conditioq includiug but not limited to, any spilling, leaking, discherge,release or Chreat of release of any
<br /> Hazardous Substance,and(c)any condition caused by the presence,use or rcleasc of a Hazardous Substance
<br /> which adversely affects the value of the Property. If Bvrrower leams, or is notified by any govemmental or
<br /> regulatory authority,or any private party,that any removal or other remedia[ion of any Hazardous Substance
<br /> affecting the Property is necessary, Bonower shall promptly take all necessary remedial actious in
<br /> accordance with Envitonmeu[al Law,Notluug herein shall create any obligation ou Lcnder for an
<br /> Environmental Cleanup.
<br /> Non-UniformCovenants.Bonower and Leuder covenant and agree as follows:
<br /> 22. Accele�ation;Remedies.LendershallgivenoticetoBorrowerpriortoaccelerationfollowing
<br /> Borrower's breach of any covenant or agreement in this Security Instrument(but not prior to
<br /> acceleration under Secdon 18 unless Applicable Law provides otherwise).The notice shall speciTy: (a)
<br /> the defaalt; (b)the acEion required to cure the default; (c} a date,uot less t6an 30 days from the dete
<br /> the notice is given to Borrower,by which the default must be cured;and(d)tNat failure to cure the
<br /> default on or before the date speci5ed in the notice may result in acceleration of the sums secured by
<br /> this Security Instrument and sale of the Property.The notice shall further inform Borrower of the
<br /> right to reinstate afrer acceleration and t6e right to bring e court action to assert the non-existeuce of a
<br /> default or any other defense oF Borrower to acceleration and sale.If the default is not cured on or
<br /> before the date speciFied in the notice,Lender at its option may require immediate payment in full of
<br /> all suros secured by this Security Instruroent without further deroand aud may iuvoke the power of sale
<br /> aod any ot6er remedies permitted by Applicable Law. Lender shall be enfitled to collect alI expenses
<br /> incurred in pursuing the remedies provided in this Sectioo 22,including, but not limited to,reasonahle
<br /> attorneys'fees and costs of title evidence.
