Box 218, Osceola, NE 68651- 0218. <br />THIS AGREES is made and entered into this 21 day of N overdo cc- <br />2012, by and between Pilot Travel Centers LLC a Delaware Limited Liability Company <br />(hereinafter "Pilot ") and Platte River Recovery Implementation Foundation, a Nebraska <br />Non -Profit Corporation, Trustee (hereinafter "PRRIF "). <br />WHEREAS, on July 8,1969, Waldemar H. Lambrecht and Maxine W. Lambrecht, <br />husband and wife, Parties of the First Part, and Darrell D. Lemke and Frieda M. Lemke, as joint <br />tenants, Parties of the Second Part, and Warren Garrett, Party of the Third Part, entered into a <br />Memorandum Agreement (hereinafter "Easement") which was recorded at Book 27, Page 561 of <br />the Miscellaneous Records of Platte County, Nebraska; and <br />WHEREAS, in the above Easement, Parties of the First Part granted to Parties of the <br />Second Part an easement for the purpose of constructing, operating, maintaining, extending, <br />repairing, replacing, and removing a sewer pipe, along with rights of ingress and egress for the <br />purposes of exercising these rights; and <br />WHEREAS, Pilot are the successors in interest to the property owned by the Parties of <br />the Second Part, which is described on the attached Exhibit "A "; and <br />WHEREAS, PRRIF are the successors in interest to the property owned by the Parties of <br />the First Part, which is described on the attached Exhibit `B "; and <br />WHEREAS, the sewer pipe referred to in the Easement is no longer in use and the parties <br />hereto desire to terminate said Easement. <br />IN CONSIDERATION OF THE MUTUAL COVENANTS AND AGREEMENTS <br />HEREIN, THE PARTIES AGREE TO THE FOLLOWING: <br />'Z O .
