<br /> DEFINITlONS. The followiny words sh211 have the foliowing meanings evhen used in this�eed of Trust:

<br /> Borrower. The word "Borrower" means AARON T DALRYMPLE 2nd KATIE M DALRYMPLE antl includes all
<br /> co-signers and co-makers siyning the Note and all their successors and assigns.
<br /> Deed of Trust. The words "Deed of Trust" mean this Deed of Trust among Trustor, Lender, and Trustee, and
<br /> indudes without limitation all assignmenY and security inferest provisions relating to the Personal Property and
<br /> Rents.
<br /> Environmental Laws. The words "Environmental Laws" mean any and all state, (ederal and Ioczl statules,
<br /> regulations and ordinances relating to the protecYion of human fiealth or the environment, induding without
<br /> limitation the Comprehensive Environmental Response,Compensation, and Liability Act of 7980, as amended,42
<br /> U.S.C. Section 9601,et seq. ("CERCLA"1,the SuperFund Amendments and Reauthorization Act o'F 1986,Pub. L.
<br /> No.99-499("SARA"},the Hazardous Materials Transportatio�Act,49 U.S.C.Section 1801,et seq:,tne Resource
<br /> Conservation and Recovery Act,42 U.S.C. Section 69�J1,et seq.,or other applica6le staTe or federal tlaws,rules,
<br /> or regulations adopted pursuant,hereto.
<br /> - Event of Default. The words"Event of Default"mean any of the events of default se[forth in this Deed of Trust in
<br /> the events ot default section of this Deed of Trust.
<br /> Guaranty. The word"Guaranty"means the guaranty from guarantor,endorser,sureLy,or accommodatiort par�y to
<br /> Lender,including without limitaiion a guaranty of all or part of the Note:
<br /> Hazardous Substances. The voords "Hazardous Substances" mean materials that, because of their quantity,
<br /> concentretion or pirysical, chemical or infectious characteristics, may cause or pose a present or potential hazard
<br /> to human health or the environment when improperly used,treated,stored,disp�sed of,generated,manufactured,
<br /> transported'or otherwise handled. The words"Hazardous Subsiances" are used in their very broadest sense and
<br /> include without limitati�n any and all hazartlous or toxic subsiances, materiais or waste as detined 6y or listed
<br /> under the Environmen2al l.aws. The term"Hazarclous Substances" also includes,evithouf limitaiion,petroleum and
<br /> petroleum by-products or any fraction thereof and asbesEos.
<br /> improvements. The ovord "Improvemcnts" means all existing an� future improvements, bui1dings, siructures,
<br /> mobile homes affixed on the Rea!Property, iacilities,. additions, replacements and o[fier construction on the Real
<br /> Property.. �
<br /> Indebtedness. The word "IndebCedness" means all principal, interest, and other amounts, costs and expenses
<br /> payable under the Note or Related Documents, together witfi all renewals of, extensions of, modifications of,
<br /> consolidations of and suhstitutions for the Note or Related�Documents and any amounts expended or advanced 6y
<br /> Lender to discharge Trustor's oblic�ations or expenses incurred by Trustee or Lender to enforce Trustor's
<br /> obligations under this Deed of Trust together with interest on such amounts as provided in this Deed of Trust.
<br /> Lender. The N�ord "Lender" means Equitable Bank, its successors and assigns. The words "successors or
<br /> assigns"me�n any person or company that acquires any interest in the Note.
<br /> Note. The word "Note" means the oromissory note dated November 26, 20�12, Ift tNiB OYiglnal pYincipal
<br /> smount of 5175,846.45 from Trustor to Lerder,together wiYh all rene�Nals of,exte�sions of,modifications
<br /> of,refinancongs of,consofidations of,and substitutions fer the promissory note or agreemeni. The maturiYy date of
<br /> this Deed of Trust is December 7,2013. ,
<br /> Personat Property. The words "Personal Property" mean alI equipment, fixtures, and other articles of personal
<br /> property now or herea(ter owned by Trustor, and now or hereafter attached or affixed to the Real Property;
<br /> together with all accessions, parts, and additions to, all replacements of, and ail substitutions for, any of such
<br /> property; and togeiher �vith all proceeds (including �vithout limitation all insurance proceeds and refunds ofi
<br /> premiums)from any sale or other disposition ofi the Property.
<br /> Property. The word"Property"means collectively the Real Property antl the Persorral Property.
<br /> Real Property.. The words"Real Property"mean the real property,interests and rights,as further described in this
<br /> Deed of Trust.
<br /> Ralated Documents. The words "Related Documents" mean all promissory nofes, credit agreements, loan
<br /> agreements, environmental agreements, guaranties, security agreements, mortgages, deeds of trust, security
<br /> deeds, coifateral mortgages, and all other ins�truments, agreements and documents, whether now or hereafter
<br /> existing,executed in connection wiih the Indebtedness.
<br /> Rents. The word "Rents" means all present and future rents, revenues, income, Issues, royal�Ies, profits, and
<br /> other 6enefits derived from the Property.
<br /> Trustee. The word "Trustee" means Equitable Bank(Grand island Region�, tivhose address is 113-195 N Locust
<br /> St;PO Box 160,Grand Island,NE 68802-01 60?nd any substitute or successor trustees.
<br /> Trustor. The word"Trustor"means AARON T�ALRYMPLE and KATIE M DALRYMPLE.
