Borrower shall aot cause or permit tLe presence, use, disposal, storage, or release <br /> of any Hazardous Substances on or in the Property. The preceding two sente�es <br /> shall not apply to the presence,use, or storage on the Properry of smali quantities of Hazardous Sl�bstances <br /> thxt are generally recognized to be appropriate to�rmal residential uses and to maintenance of the Property. <br /> Borrower shall prompfly give I.ender wri[[en notice of auy investigation, claim, demand, lawsuit or other <br /> action by any governmental or regulatory agency or private pazCy involving the Property and any Hazardous <br /> Substance or Environmental I.aw of which Botrower has actual lmowledge. If Borrower learns, or is notified <br /> by any govemmental or regulatory authority,that any removal or other remediation of any Aazanious <br /> Substances affecting the Property is necessary, Borrower shall promptly take all necessary rcmedial actions <br /> in accordance with Enduonmental I,aw. <br /> As used in this paragrapL 16,"Hazardous Substances"are those substances defined as m�cic or hazardous <br /> subsiances by Environmental I.aw and the following substances:gasoline,kerosene,o[her flamma6le ot[oxic - <br /> petroleum products,to�cic pesticides and herbieides,votatile solvents,mate�ials containing asbestos or <br /> formaldehyde,and radioac[ive me[erials.As used in this paragraph 16,"Environmental Law"means federal <br /> laws and laws of the jurisdiction where the Proper[y is located tl�at relate to health,safety or environmental <br /> protection. <br /> Non-U�iform Covenants. Borrower and Lender further covenant and agree as follows: <br /> 17. Assignment of Rents. Borrower uncondirionally assigns and lransfers to Lender all the rents and revenues <br /> of the Property. Borrower authorizes Lender or Lender's agents to wllect the rents and revenues and hereby <br /> directs each tenant of the ProPerty[o pay the rents to Lender or I.ender's agents. However,prior[o Lender's <br /> nofice to Borrower of Borrower's breach of any covenant or agreement in[6e Security Instrumen[, Borrower <br /> sLall collect and receive all rents and revemxes of Uie Property as trustee for the benefit of I.ender and <br /> Borrower. TLis assignment of reuts wns[itutes an xbsolute assignment and nof an assignment for additional <br /> sccurity only. <br /> If Lender gives notice of breach to Borrower: (a)aIl rents received by Borrower shall be held by Borrower <br /> as trustee for benefit of Lender only, to be applied to the sums secured by [he Security Inshument; (b) � <br /> Lender shall be entitled to collect and receive all of the rents of tt�e Property; and(c) each tenant of the <br /> Property shall pay all rents due a�unpaid[o Lender or Ixnder's agcnt on I.ender's written demand to che <br /> tenant. <br /> Borrower has not execu[ed any prior assignment of the rents and has not and will not perForm any act that <br /> would prevent I,ender from exercising i[s righls under Ihis paragrnph f 7. <br /> Lender shall no[be requ'ved to enter upon, take control of or maintain the Properry before or after giving <br /> mdce of breach to Borrower. However, Lender or a judicially appointcd receiver may do so at any time <br /> there is a breach. Any applica[ion of rents shall no[cure or waive any default or invalidate any other right or <br /> remedy of Lender. Tlvs assigument of rents of the Property sLall terminate when the deb[secured by [he <br /> Secority Instrument is paid in full. <br /> 78. Foreclosure Procedure. If I.ender requires immediate peyment in full under paragraph 9,I,ender <br /> may invoke the power of sale and any other remedies permitted by applicable law.
