<br /> H. ASSIGNMENI' Ul�' 1t�NTS; APFOINTMENT OI�' R�C�IVEtt: LENDER IN POSSESSION.
<br /> Borrawer absolutcly and unconditionally acsigns and transfers to l.ender all the rents and revenues("Rent.s")of
<br /> thc Property, regardless of to whom the Rents of the PropeRy nrc payable. Borrower authorlus Lender or
<br /> I.ender's agents ta collect the Rents,and agrees that each tenant of thc Property shall pay the Rents to Lender or
<br /> I.ender's agents.However, Barrower shall reccive the Rents until (i) Lcnder has given Borrower notice of default
<br /> pursuant ta paragraph 21 of the Security Instrument and(ii) L.ender has given notice to the tenant(s)that the Rents
<br /> are to be pald to L.ender or Lender's agent. This assignment of Rents constitutes an nbsolute assi�ntnent und not
<br /> an ussignment for additional security only.
<br /> If Lender gives notice of breach to Borrower: (i) all Rents received by Bonower shatl be held by Borrawer
<br /> a5 tntstee far the benefit of Lender only,to bc applied to the sums secured by the Seturity Instrument:(ii)L.ender
<br /> shall be entitled to collect and receive all of the Renu of the Propeny; (iii)Borrower ugrees that each tenant of the
<br /> Property shall pay al! Rents due and unpaid to Lender ar L.ender's agents upon Lender's written demand to the
<br /> tenant; (iv)unless applicable law provides othenvise, all Rents collected by Lender or Lender's ugents sball be
<br /> applied first to the costs of taking control of and managing the Propeny and collecting the Rents,tncluding, but
<br /> not limited to, attarneys' fees, receiver's fees, premiums on receiver's bonds, repair and maintenance costs,
<br /> insurance premiums, taxes, assessments and other charges on the Praperty,and then to the sums secured by the
<br /> Security Instrument;(v)Lender, Lender's ngents or any judieinlly appaintecf receiver shall be lial�le to aceuunt for
<br /> only those Rents actually received; and (vi) l.ender shall be entitled ta have a receiver appointed to ta1,e
<br /> possession of and munuge the Property and collect the Rents and profits derived from the Property wtthout any
<br /> showing as to the inadequacy of the Property as security.
<br /> If the Rents of the Property ure not sufficient to cover the costs of taking control of and managing the
<br /> Property and of collecting the Rents uny funds expended by Lender for such purposes shall become indebtedness
<br /> of Borrower to Lender secured by the Security Instrument pursuant to Uniform Covenant 7.
<br /> Borrower represents and warrants thut Borrower has not executed any prior assignment of tlie Rents and has
<br /> not and wlll not petform anv act that would prevent Lender from exercising its rigbts under this parugraph.
<br /> L,ender, ar L.ender's agents or a judicially appointed receiver. shall not be required to enter upon, take
<br /> control of or maintain the Property before or after giving notice of default to Borrower. However, Lender. or
<br /> I.ender's agents or a judicially appointed receiver,may do so at any [ime when a default occurs. Any applicatton
<br /> of Rents shnll not cure or waive any default or invalidate any other right or mmedy of Lender.This assfgnnxnt of
<br /> Rents of the Property shall terminate when all the sums secured by the Security Instrument are paid in full.
<br /> 1. CROSS-DEFAULT PROVISION. Borro�ver's defiiult or breach under any nate or agreement in which
<br /> Lender has nn interest shall be a breach under the Security Instrument nnd I.ender may invoke uny of the remedies
<br /> permitted by the Security Instrument.
